CITY COUNCIL TCAAP WORK SESSION MEETING

CALL TO ORDER/ROLL CALL
Pursuant to due call and notice thereof, Mayor Stan Harpstead called to order the City
Council TCAAP Work Session meeting at 6:02 p.m.
Present: Mayor Stan Harpstead, David Grant, and Brenda Holden.
Absent: Councilmember Fran Holmes and Dave McClung.

Also present: City Administrator, Patrick Klaers; Community Development ment Director,
James Lehnhoff; and City Planner, Meagan Beekman.

MOTION: Councilmember Holden moved and Councilmember Grant seconded a motion
to approve the meetinLy a enda as amended addinLy Item 2B Discuss GSA
Conference Call. The motion carried unanimousl 3-0 .
1. COUNCIL COMMENTS AND REQUESTS
None.
2. AGENDA ITEMS
A. TCAAP Zoning Project
Community Development Director Lehnhoff presented the City Council with information on
the TCAAP zoning project. He explained this would be the Council's last time to review the
document before the Planning Commission public hearing. The Council would like to review the
resolutions for adoption on June 28, 2010.

Community Development Director Lehnhoff indicated additional changes could be made after
the public hearing, but significant changes should be made at this time. He stated the
development would encourage parking ramps or parking structures while also limiting the size of
fueling stations as requested. A definition would be added for pawn shop and assisted
living/nursing home facility.
Councilmember Holden expressed concern about places of worship with an accessory building.
Community Development Director Lehnhoff felt this issue could be further clarified within the
code.
Councilmember Grant asked if a large scale development of regional significance was addressed
within the zoning regulations.
City Planner Beekman indicated the top paragraph of Page 7 referred to a development with
regional significance.
Community Development Director Lehnhoff indicated language was written into the document
stating the overall purpose for the property was to encourage a development with regional
significance.
Councilmember Grant stated he felt this language was not strong enough.
Mayor Harpstead questioned if a "such as a Major League sports facility" statement could be
added in this area.
Councilmember Holden indicated this could lead to other sports venues that were not welcome
on the site.
Community Development Director Lehnhoff stated staff could add a statement under the
prohibited uses expanding which uses would not be allowed on the site, notably a racetrack. The
Council was in favor with this suggestion.
Community Development Director Lehnhoff asked how the Council wanted to proceed with
non-profit uses on the TCAAP site. After speaking with the consultant, this would be something
the Council could prohibit but the consultant stated that other institutional uses would also need to
be prohibited, including educational uses.
Councilmember Holden was not interested in having any additional institutional uses, including
nursing homes on the TCAAP site. The City funded a great deal of public services to support

these uses and if these uses could not be eliminated completely, than the size should be limited.
Community Development Director Lehnhoff stated the Council could limit the size.

Mayor Harpstead stated that the City may need to consider these services as the population was
aging. He suggested that user fees be further explored to assist with public services. Mayor
Harpstead requested staff draft language within the code to limit the size of nursing homes on the
TCAAP site.
Mayor Harpstead questioned what comments were received from the Planning Commission.
City Planner Beekman reviewed the Planning Commission comments noting they have
suggested changes to environmental ire ulations and land uses. The majority of their comments

have been in alignment with the Council's comments.
Councilmember Holden asked if the code would allow for antennas, dishes or towers.
Community Development Director Lehnhoff explained these would only be allowed if an
accessory use and do require a conditional use permit.
Councilmember Holden questioned if earth shelters would be allowed.
City Planner Beekman stated this was an outdated portion of the code and she recommended it
be removed from the land use chart. The Council was in favor with this suggestion.
Councilmember Holden asked how the Council would like to proceed with houses of worship.
She indicated she would be in favor of removing the use from the TCAAP site.
Councilmember Grant stated he was in favor of allowing a house of worship but that if this door
was open it would allow for everything else.
Community Development Director Lehnhoff stated the developer was going to be interested in
TIF and houses of worship would have no increment. He imagined the developer would not be
interested in selling off a large portion of property to a tax exempt user, but that is only a guess at
this time.
Mayor Harpstead stated it would not be in the City's best interests to prohibit houses of worship.
Community Development Director Lehnhoff indicated the City would not be prohibiting house
of worship but instead would be stating this zone was not appropriate for that use. He stated the
consultant also recommended prohibiting general and higher education as well. Staff would be
speaking further with the attorney to better understand this issue. The Council was in favor of
removing the house of worship but leaving in the education language at this time.
Mayor Harpstead explained he fully expected the developer to request amendments to the code
while the development took place to create blending, especially in this area.

Councilmember Grant suggested a nursery be an accessory use to retail.
City Planner Beekman indicated garden centers were permitted as part of retail. She suggested
the nursery be a conditional use.
City Planner Beekman stated that the Planning Commission felt 10,000 square feet was too low
for minimum building size required to implement the environmental sustainability component and
had recommended 25,000 square feet be used instead.
Mayor Harpstead suggested the square footage be changed to 15,000 square feet.
Community Development Director Lehnhoff agreed with this recommendation.
Mayor Harpstead questioned Subdivision 14, the construction staging component. He asked if
there would be consequences relative to the staging.
City Planner Beekman stated the development agreement would lay out a timetable and the PUD
approval would lapse if milestones were not met.
Councilmember Grant asked if gambling was addressed within the zoning code.
Community Development Director Lehnhoff explained casinos were not a permitted use and
did not fit under a retail use. The City Code further regulates gambling.
B. Discuss GSA Conference Call
Councilmember Holden stated the Cityhad a conference call with Kevin Lea on May 20tn.

The City questioned the lease/licensing issue again as this was federal property. Little information
was gained through the conversation. She indicated the GSA will need to further think this issue
through.
Councilmember Holden explained she spoke with Mike Comadeca after the GSA conference
call and the City can take the IFB when it comes or take the initiative to protect the City against
the lease/licensing. She recommended Mike speak with Carmen, the GSA and the Army to
discuss this issue further.
Mayor Harpstead stated he would like to see the City be able to leverage the site with TIF and if
the lease prohibits this, it would be a problem for the City. He suggested staff proceed as
recommended by Councilmember Holden.
Mayor Harpstead felt it would be appropriate for Mike Comadeca to bring back a
recommendation to Council for action on this issue. This recommendation could be in the form of
a resolution stating the property should not be tied up in a lease/license in federal land.

2.B Discuss GSA Conference Call
Councilmember Holden added that police services would need to be discussed prior to the
auction as well in order to have them available when necessary. She wanted to be assured that the
site was cleaned if under a lease as well.
Mayor Harpstead stated it would be in the best interest of the City to be sure the property
maintains an economic value.
Councilmember Holden indicated the Army/GSA has not leased property before and she wanted
assurances that the City's best interests were taken into consideration through this process.
