Written objections were submitted by seven property owners; copies of the objections are attached. The following is a brief description of each of the objections, followed by a staff analysis. A letter from the City Attorney regarding the objections is also attached, indicating that the City Council should act on each objection individually. Obiections 1. 3314/3317 Katie Lane, Dan and Janice Christensen The property owners live at 3 314 Katie Lane, and own the vacant parcel at 3 317 Katie Lane. The owners indicate that they do not intend to develop the second platted parcel, and request deferring the assessment or entering into a contract similarly to 1645 Valentine Avenue and 4093 Valentine Crest Road. 2. 4090 Valentine Crest Road, John and Karen Albert The property owners object to the assessment methodology, and request an assessment based on front footage instead of per unit. The property owners also noted that some of the single family homes have more than one family living in them, and had concerns about street width and utility improvements. 3. 4082 Valentine Crest Road, Shirley Fer uson The property owner objects to the amount of the assessment and the proposed interest rate. The owner also indicated they incurred plumbing costs as a result of the project. 5. 4075 Valentine Crest Road, Scott and Kathryn Scheunemann The property owners object to the amount of the assessment. 6. 4109 Valentine Crest Road, Kathleen Smith The property owner obj ects to the amount of the assessment, the interest rate, the assessment methodology as it relates to single family homes with multiple families living there, and the level of improvement on Valentine Crest Road compared to Valentine Court and Valentine Avenue. 7. 4112 Valentine Crest Road, Jeffre� and Gail Weber The property owners object to the assessment methodology, the amount of the assessment, property value, street width, and utility improvements. A- '�. Katie Lane �arcel�obiection 1 � The City Council asked staff to research what had been done on the 2003 PMP with a similar parcel. This parcel was owned by the Josephine Hills Lake Association, who requested that their assessment be reconsidered. The association believed that, while it was considered a buildable lot per City codes and ordinances, it was not a lot that would be built upon. The City Council voted to remove the parcel from the assessment roll. As stated by the City Attorney, options for the City Council include, but are not limited to, the following actions: ■ Assess two units at this time, making no change to the proposed assessment roll ■ Assess one unit at this time, and defer the second assessment. A future development of the property would trigger the payment of the deferred assessment. All deferred assessments must be paid within 30 years of the date of the adoption of the deferred assessment roll, even if development has not occurred. ■ Adopt a supplemental assessment roll when the subdivision of the property occurs. The City would need to follow all of the process that it does when it adopts a normal assessment roll but, only those people who would be receiving a supplemental assessment would need to be notified. ■ Forgive the second assessment. The City Attorney drafted an agreement which states that the assessment for the second lot will not be assessed at this time, but will be deferred and due in 15 years or prior to the issuance of any building permits, whichever occurs first. This agreement would be signed in place of adopting a deferred assessment roll or supplemental assessment roll. A copy of the agreement is attached. Parcels that are sub-dividable according to the current City Code (1645 Valentine Avenue and 4093 Valentine Crest Road) have been included in the assessment calculation as two residential equivalent units (REU). The City has developed agreements with these property owners not to assess the second unit until a subdivision occurs. These agreements did not result in an increase to the assessment amount. The proposed interest rate is a deviation from the City's Assessment Policy. The Assessment Policy states that the interest rate shall be set at prime plus two percent. Prime rate is currently 3.25%; this would mean an interest rate of 5.25%. The current annualized rate of return on the City's portfolio is 2.5%. The City Council directed staff to set the interest rate at 2% over the annualized rate of return, or 4.5%. The proposed interest rate has been set lower than what is stated by the policy, which is in favor of the residents. The Assessment Policy states that the payments shall be equal principle payments. This means the principal payment is the same every year (total assessment divided by number of years in the payment period), but the interest payment the total interest on the balance of the principle in a given year. The payments will decrease every year, as the balance will become less, and interest to be paid will then be lower as well. The payment plan has been changed to equal annual installments, so that the payment would be equalized for the term and more manageable for residents, as they could budget the same amount of money for a payment each year. In an effort to alleviate the financial burden of the assessment, the City Council could choose to make the following changes for this project: a. The length of the payment period could be extended longer than the ten (10) years that is stated in the Assessment Policy. One thing to note is that with an extended payment period, residents would pay more in interest. b. The Assessment Policy does have an option for senior citizens, which was described at the August 9, 2010 City Council meeting. For this deferral, residents must be 65 years of age or older and must establish economic hardship (an annual gross income of less than 50% of Ramsey County median household income, which is $45,722 based on the 2000 census.) Applicants need to fill out a deferral form available at City Hall and provide supporting tax documents for City approval. If approved, the assessments are deferred with interest until the property is sold. This ensures that the city receives their money, but also helps those on a fixed income while they are still in their home. These homes are classified as single family homes and do not meet the legal definition of multi-family dwelling, therefore, there is no legal action City can take. The properties are zoned R-1 single family, and have been assessed at one REU per property, except as noted. Desi�n-related concerns (objections 2, 4, 6 and 7�: Valentine Crest Road was constructed as designed and shown on the plans, at 28 feet from back of curb to back of curb. This, however, was a change from the feasibility report, where the road width was proposed to be 28 feet from face of curb to face of curb. During final design, this change was made to reduce impacts to residents' yards, to reduce the cost of the project, and to reduce the amount of stormwater treatment needed to meet the Rice Creek Watershed District's requirements for impervious surfaces. Additional parking restrictions are not proposed as a part of this project; the existing parking restrictions will remain in place. The utilities were reviewed during feasibility and final design, and improvements were made where needed. The sanitary sewer was replaced in its entirety on Valentine Court and several sections of Valentine Avenue from manhole to manhole. Sections of the sanitary sewer were replaced on Valentine Crest Road, where sags had been identified. Other sections of Valentine Crest Road have been identified as a future sanitary sewer-lining project. Only a portion of the watermain in the neighborhood was replaced. Watermain improvements on Valentine Crest Road consisted of gate valve and hydrant replacements. �ne property owner indicated that they incurred plumbing expenses as a result of the project. Staff has contacted the property owner and informed them that they may submit their claim if they would like it to be addressed. Schedule The following is a proposed schedule for 2010 assessments: August 30 Council adopts assessment roll August 31 to September 29 Assessment pre-payment period at Arden Hills City Hall (30 days) October 31 Certification of final assessment roll to Ramsey County Council Action Requested Approval of Resolution 2010-039, adopting and confirming assessments for the 2010 PMP improvements. Such proposed assessment roll, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment assessed against each parcel of land on Valentine Avenue, Valentine Crest Road, and Valentine Court shall be payable in equal annual installments extending over a period of ten (10) years, unless prepaid, the first of the installments to be payable with general taxes levied in 2410, collectible with such taxes during the year of 2011. Such assessment assessed against each parcel of land on Katie Lane and Katie Court will be payable, unless prepaid, in five (5) equal annual installments, the first of such installments to be payable with general taxes levied in 2010, collectible with such taxes during the year of 2011. The assessment shall bear interest at the rate of 4.5 percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2010. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. If the adopted assessment differs from the proposed assessment as to any particular lot, piece, or parcel of land, the City Administrator shall mail to the owner a notice stating the amount of the adopted assessment. The administrator must also notify affected owners of any changes adopted by the Council in interest rates or prepayment requirements from those contained in the notice of the proposed assessment. 4. The owner of any property so assessed may, at any time prior to certification of the assessment to the county auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City Administrator, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution. The owner may at any time thereafter, pay to the County Auditor the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the succeeding year. S. The City Administrator shall forthwith prepare and transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the county.
