Planning Cases are available online at: http://www.ci.arden-hills.mn.us/planningcases -----AV � ENHILLS MEMORANDUM DATE: September 8, 2010 PC Agenda Item 3*A TO: Planning Commission FROM: Meagan Beekman, City Planner SUBJECT: Planning Case#10-009 -This application requires a PUBLIC HEARING Applicant: 1201 County Road E LLC (TAT Properties LLC) Property Location: 1201 West County Road E Request: Zoning Code Amendment, Preliminary and Final Plat, Master and Final Planned Unit Development Requested Action The applicant has requested a Zoning Code Amendment, Preliminary and Final Plat, and Master and Final Planned Unit Development(PUD)to allow the existing student housing facility located at 1201 County Road E, the former Holiday Inn site, to convert from an interim to a permanent use. Background 1. Overview of Request: In March 2008 the City approved a request from TAT Properties and Northwestern College granting an Interim Use Permit (IUP) at the former Holiday Inn property that would allow the College to operate a student housing facility in the B-2 District. TAT Properties had purchased the building and intended to lease it to Northwestern College. The IUP is set to expire May 30, 2011. Student housing is currently defined as "institutional housing" in the City's Zoning Code. As part of the approval the City adopted an IUP process, and amended the City's land use chart to allow institutional housing as an interim use in the B-2 District, under certain circumstances. At the time of the IUP approval the City was just beginning the process of developing the Guiding Plan for the B-2 District, which was ultimately adopted in October 2008. When the City's zoning regulations were consequently amended to incorporate the goals of the Guiding Plan shortly after it was adopted, institutional housing as an interim use in the B-2 District City of Arden Hills Planning Commission Meeting for September 8, 2010 C:IDOCUME—I IMEAGAN—I.BEEILOCALS—I I TempIELF8109-08-10-PC Report-Arden Hall.doc Page 1 of 14 was removed from the Zoning Code. However, the interim use permit process itself remains within the Code as an optional tool for future development in the City. Sighting a number of factors, including the slowed economy over the past several years, Northwestern College was not able to construct on-campus student housing, as was originally planned. At present, Arden Hall has proven to be a success for Northwestern College. As an alternative to losing the capacity to house the students living in Arden Hall when the IUP expires at the end of this school year,Northwestern College is proposing to extend their lease with TAT Properties and continue the operation of their student housing facility. In turn, TAT Properties has found it more difficult than originally anticipated to find a viable redevelopment option for the property, and has submitted an application to the City requesting the current interim use of the building be converted to a permanent use. Presently, the Zoning Code does not identify institutional housing as a permitted or conditional use within the B-2 District. Land uses that are not specifically identified in a city's zoning code as permitted or conditional uses are considered prohibited. In order to accommodate the applicant's request to allow the student housing facility to continue operations at its current site, the request includes a proposal to amend the Zoning Code to add institutional housing as a use permitted through a PUD process in the B-2 District. This means that the use would be considered permitted, but would be required to get an approved Master and Final PUD in order to operate in the B-2 District. In addition to the request for the Zoning Code Amendment and the Master and Final PUD, the applicant's are proposing to subdivide the property into two parcels, reserving the eastern two acres of the site for a future development option that has yet to be determined. The submitted plans do include a conceptual drawing of a building that might be possible on Lot 2, but the applicants are not seeking approval for development on Lot 2 at this time. In order to accommodate the request for the subdivision, and bring the property into compliance with the City's zoning regulations,the applicants are proposing to remove a portion of the parking lot and replace it with landscaping and storm water ponding. The storm water ponding would be shared by the two parcels. The applicant is not proposing any exterior modifications to the existing building; however, they are proposing improvements to the landscaping and parking lot, as well as the removal of one curb cut along County Road E and the installation of a sidewalk. The applicant has submitted a letter outlining the reasons for the request (Attachment A), as well as a Preliminary Plat; Site, Drainage, and Utility Plan; and Landscaping Plan (Attachment E). 2. Planned Unit Development (PUD) Process The PUD process is a tool that provides additional flexibility for developments that could not otherwise be developed in the manner allowed in the underlying zoning regulations. For example, a PUD may change the setbacks, lot coverage, lot sizes, parking requirements, City of Arden Hills Planning Commission Meeting for September 8, 2010 C:IDOCUME-I IMEAGAN-I.BEETLOCALS-I I Temp1ELF8109-08-10-PC Report-Arden Hall.doc Page 2 of 14 signage, building height, building materials, landscaping requirements, etc. The process is meant to create a better development than the standard regulations may otherwise allow. The PUD process allows the City to negotiate certain aspects of the development; however, any conditions imposed on the PUD must have a rational basis related to the impacts of the development. While each PUD process is unique, it is a common process used by many cities. The PUD process cannot be used to permit uses that would not otherwise be permitted in the underlying zone. If a property is subdivided into multiple properties during the PUD process, it is still often viewed as one continuous development. The development as a whole would be expected to meet the parking, landscaping, stormwater, and other similar requirements. In order to maintain shared amenities the development is required to enter into agreements between property owners to manage and maintain the shared amenities. The Planned Unit Development (PUD) process is typically at least a two step process. The first step is the Master PUD, which is a detailed concept plan for the entire development proposal, often outlining individual phases for development over a specified period of time. The second step is the Final PUD for each phase, which is a more detailed review as each development phase moves forward. Because the use of Lot 2 has yet to be decided and remains conceptual on the submitted plans, Lot 2 will be required to get a separate approved Master and Final PUD prior to its development. 3. Proposed Zoning Code Amendment The applicant is requesting institutional housing be added as a permitted use, if approved through the PUD process, in the B-2: General Business District Zone. The B-2 Zone generally encompasses those properties along County Road E between Lexington Avenue and Highway S 1/Snelling Avenue. Section 1320.04 Subd 1 states that the purpose of the B-2: General Business District is: A. To be a place in which people can live, work and play. B. To create a compact, architecturally diverse,pedestrian- and bicycle-friendly community with a distinct identity. C. To provide a connected sidewalk system and places for people to gather and socialize. D. To implement design standards to promote an attractive environment with lasting and sustainable value. E. To group compatible retail and service business uses that tend to draw trade that is naturally interchangeable and promotes business prosperity. F. To provide an adequate supply of businesses and professional service areas to meet the needs of the residents. G. To minimize the effects of traffic congestion,noise, odor, glare and similar safety problems. H. To implement the Plan known as the "Guiding Plan for the B2 District,"which was adopted by the City Council on October 27, 2008. Currently, the Zoning Code permits institutional housing as a conditional use in all residential districts in the City and the CC: Civic Center District. With the adoption of the Guiding Plan for the B-2 District a number of changes to the Zoning Code were also instituted. Multiple-family housing was added as a permitted use, through a PUD process, in the B-2 District at that time. Institutional housing is defined in Section 1305.04 Subd. 80 of the Zoning Code as: Institutional housing. Student or faculty housing for four (4) or more persons on rental basis, rest home, hospital, sanatorium, nursing home, convalescent home, orphan home. City of Arden Hills Planning Commission Meeting for September 8, 2010 C:I DOCUME I I MEAGAN—L BEET LOCALS—I I Temp I ELFM9-08-10-PC Report-Arden Hall.doc Page 4 of 14 The City does not have a specific set of review criteria for evaluating a Zoning Code amendment; however,the primary issues to consider include (but are not limited to): 1. Is the proposed use compatible with the other uses in the B-2 Zone? 2. How will the proposed use affect the B-2 Zone? When reviewing a Zoning Code amendment or addition, it is important to consider how the change would affect the entire zone instead of one specific property. If approved as proposed, institutional housing could, in theory, be a permitted use through a PUD process on any property in the B-2 Zone. However, the proposed ordinance requires that in order for an institutional housing use to be approved, it would have to be located in an existing hotel/motel use within the district. This regulation effectively limits this type of use to the proposed property. 2. Zoning Regulations This application is unique because the request is regarding the use of a building and site that is already developed. The typical evaluation as to whether or not the proposed plan meets the minimum requirements of the Zoning Code is more difficult given that there are certain aspects of the site that cannot reasonably be altered, such as the setbacks of the building. That being said there are certain reasonable improvements that can be required for the property given the nature of the PUD process and the City's broad discretion when reviewing requests for amendments to the Zoning Code. Section 1320.085 Subd. 5 — Proposed Special Requirements for Institutional Housing in the B-2 District(Attachment Q Meets Requirements The evaluation criteria in section A below are based upon the proposed Zoning Code amendment to add institutional housing as a permitted use in the B-2 District through the PUD process. Institutional Housing Additional Planned Unit Development Criteria. In addition to meeting the requirements of Section 1325, an existing hotel-motel use may be used for institutional housing upon approval of a Master Planned Unit Development provided that all of the following requirements are met: 1. The building to be used for institutional housing meets applicable building and fire codes as determined by the Fire Marshal and Building Official; 2. Each room that has occupants on an overnight basis shall have bathroom facilities within the room; 3. The institutional housing shall only be used for student or faculty housing. Rest homes, hospitals, sanatorium, nursing home, convalescent homes, and orphan homes shall not be permitted. 5. A regularly scheduled shuttle shall be provided to and from the college or campus for which the institutional housing is being used nursing home, convalescent homes, and orphan homes shall not be permitted Section 1320.06—District Requirements Chart—Meets Requirements A. B. Setbacks: The minimum setbacks in the B2 District are 20 feet in the front and rear and 10 feet in the side yards. The existing building exceeds the minimum setbacks for this District. The conceptual building shown on Lot 2 meets the minimum setbacks. This indicates that it is possible for the property to comply with setbacks when it is ultimately developed; however, the exact placement of the building will be determined by a future Master PUD review. Section 1325—General Regulations A. Landscaping and Tree Preservation- Section 1325.05 Subd. 1 and 1325.055 Caliper Inches Required—Exceeds Requirements A Landscaping Plan was submitted by the applicant and is included in Attachment D. Based on the square footage of the proposed buildings the City Code requires 320 caliper inches of trees to be located on site; however, existing and preserved trees on the site are permitted to count towards this requirement. There are currently 530 caliper inches of trees on site. No trees are proposed to be removed at this time; however, it is likely that trees will need to be removed with the development of Lot 2. The specific tree replacement requirements will be calculated with the application for the development of Lot 2. Trees along Street Frontage—Meets Requirements City of Arden Hills Planning Commission Meeting for September 8, 2010 C:IDOCUME—I WEAGAN—I.BEEILOCALS—I I TempIELFM9-08-10-PC Report-Arden Hall.doc Page 6 of 14 City Code requires that a minimum of one tree be planted along the right of way for every 40 feet of street frontage. Lot 1 has 580 feet of frontage which would require 14 trees to be planted. Their plan proposes 14 street trees with an additional 10 to be located throughout the parking lot. Perennials and Shrubberies—Flexibility Requested City Code requires that at least ten percent of the total landscaped area shall be covered with perennials and/or shrubbery. Code requires 7,300 square feet of perennials and shrubbery. The applicant is proposing 5,800 square feet. Planting Islands—Flexibility Requested City Code requires that at least ten percent of the parking area be occupied by planting islands that are at least 150 square feet in size, edged in concrete curb, and have at least one tree. The application proposed 10 planting, which would consist of 6.4 percent of the parking area. All of the proposed islands would meet the size and tree specifications of the Code. Tree Selection—Meets Requirements The selection and size of trees that will be provided on site meet the requirements of the Code. B. Design Standards—Section 1325.05 Subd. 8 Because Lot 1 has already been developed, and the building and parking lot are proposed to remain largely unchanged, the majority of the design standards that apply to the B-2 District are not applicable to this application. That being said, there are certain aspects of the design standards that do apply to this particulate application in regards to Lot 1. Lot 2 will be evaluated at the time that a proposal for development is submitted. Site Furnishings and Seating Areas Arden Hall currently has a small patio area adjacent to the student lounge. Parking Parking is currently located to the rear of the building, which is in compliance with the design standards for the B-2 District. The Code also required concrete curb around the periphery of all parking lots, access roads, and parking lot islands. The proposed plan indicates curb around most of the parking lot, and ribbon curb adjacent to the south side of the storm water pond. Staff has included a condition that all curb be constructed of concrete barrier curb, throughout the site. Lighting At this time a lighting plan has not yet been submitted; however, Staff has added a condition of approval of this application that a lighting plan be submitted that meets the requirements of the Code. Additionally, the Ramsey County Sheriff s Department has City of Arden Hills Planning Commission Meeting for September 8, 2010 C:IDOCUME—I IMEAGAN—I.BEEILOCALS-1I TempIELF8109-08-10-PC Report-Arden Hall.doc Page 7 of 14 requested that the lighting plan also comply with the Illuminating Engineering Society recommendations for parking lot lighting. Additional lighting in the parking lot area would increase safety and security of the property. Pedestrian and Bicycle Circulation The applicant is proposing six foot concrete sidewalks with a six foot boulevard adjacent to County Road E and Lexington Avenue the length of both Lots 1 and 2. The sidewalks adjacent to Lot 2 are proposed to be constructed at the time Lot 2 is developed. Staff has added a condition that the sidewalks be constructed in their entirety prior to Lot 1 being occupied. Bike racks are not shown on the plan,but are currently located on the property. The presence of bike racks has been added as a condition of approval. C. Parking— Section 1325.06—Exceeds Requirements The regulations within the City Code to determine the number of required parking spaces for a student housing facility are not clear. There. are currently 426 parking stalls between the two lots. City Code requires one parking stall for every unit in a hotel/motel use, plus one for each employee. The current building contains 155 rooms. The amount of existing parking exceeds the requirements based on the past use of the site as a hotel. As part of the improvements to increase storm water infiltration and landscaped area, the applicant is proposing to remove a portion of the parking lot and replace it with ponding. The remaining number of stalls on Lot 1 is proposed to be 253, which Northwestern College feels confident will exceed their parking needs. The maximum capacity of the building according to the existing IUP is 350 students; however, Northwestern College provides shuttle service to and from the College, reducing the need for students to park on site. Additionally, the College has the ability to grant parking permits to students, limiting the number of cars that could be parked on site. Lot 2 will be evaluated at the time of the development proposal based on that specific use. A shared parking agreement between Lot 1 and Lot 2 will be required as part an approval of this application, as well as a shared maintenance agreement for the storm water ponding area. 3. Park Dedication Park use dedications for recreation or conservation purposes would be required as part of an approval of this application, and would be determined by the City Council. According to the City's subdivision ordinance the property could be subject to a park dedication requirement of a reasonable amount dependent on the circumstances of the property, but not to exceed ten percent. Based on the Code, park dedication can be in the form of a percentage of land dedicated to the City, or as cash in lieu of a dedication. In the event of a cash dedication the amount could be up to 10 percent of the fair market value of the property. According to the City of Arden Hills Planning Commission Meeting for September 8, 2010 C:IDOCUME—I IMEAGAN—I.BEEILOCALS-1I TempIELF8109-08-10-PC Report-Arden Hall.doc Page 8 of 14 Ramsey County, the property has an assessed value of$2.7 million. The Code also requires the Council to take into consideration the amount of open space and recreation areas that are being provided on site to be used by the occupants of the development, if above and beyond the required amount. The final park dedication requirements will be determined by the City Council; however, the applicant is aware that this will be a condition of approval of the proposal. According to State Statute, cash payments made to cities in lieu of park dedication can only be used towards the construction of new recreation facilities and cannot be used to maintain existing facilities. 4. Guiding Plan for the B-2 District The existing building on Lot 1 is presently situated in a way that conforms to many of the principles in the Guiding Plan for the B-2 District. The building is situated close to the street with nearly all of the parking located to the back of the building. The use, as a student housing facility, is similar in nature to uses already permitted in the District, such as high density multiple-family housing. The subdivision of the lot into two offers an opportunity to increase the intensity and mixture of uses on the site, which is a stated goal of the Guiding Plan, and decrease excess parking. The future development of Lot 2 maintains the opportunity for a gateway entry feature, additional outdoor seating or gathering space, and an overall site plan that meets the requirements of the Zoning Code and forwards the vision of the Guiding Plan for the B-2 District. Because the site is not being fully redeveloped, but rather re-used, other principles of the Guiding Plan that relate to this site are not as clearly addressed. For example, it is not possible to realign the access drives towards a new intersection to accommodate a traffic light, because of the placement of the existing building. On the other hand there may be opportunities given the existing site layout to further advance the Guiding Plan. One example might be the addition of on-site green space or a recreation area. Furthermore, based on the use of the site as a student housing facility, and the likely demands of the users for access to recreation and outdoor space, Staff feels that the current amount of useable green space on the property is deficient. Staff initially suggested that the front access aisle be removed in favor of a landscaped green space; however, there are other potential opportunities for this type of feature in the rear of the building as well. As part of the park dedication negotiations with the property owner, it is possible that on-site amenities may be added in order to partially fulfill the applicant's park dedication obligations. 5. Additional Review The Building Official and the Fire Marshal have determined that an Occupancy Permit will be required in order to allow people to inhabit the property after May 31, 2011, when the current interim use permit expires. The Building Official and Fire Marshal have prepared City of Arden Hills Planning Commission Meeting for September 8, 2010 C:IDOCUME-1IMEAGAN-I.BEEILOCALS-1I TempIELF8109-08-10-PC Report-Arden Hall.doc Page 9 of 14 conditions of approval addressing certain building code and fire safety requirements that need to be met prior to the issuance of an occupancy permit. Provided that the requirements are met,they have no objections to the application. The City Engineer and Public Works director have prepared a memo addressing their concerns regarding the proposed plans (Attachment B). The contents of the memo have been included as conditions of approval of this application. Provided these conditions are met, the Public Works Department has no objections to this application. The Ramsey County Traffic Engineer has reviewed the proposed plans and provided comments (Attachment B). She is supportive of the closure of a curb cut onto County Road E. and has no objections to the proposed application. Findings of Fact The Planning Commission must make a finding as to whether or not the proposed application meets the requirements of the Zoning Code, advances the goals and principles within the Guiding Plan for the B-2 District, and would adversely affect the surrounding neighborhood or the community as a whole. Staff offers the following seventeen findings for consideration: General Findings: 1. If the proposed Zoning Code changes in Planning Case 10-009 are approved, institutional housing would be a permitted use, under certain circumstances, with an approved PUD, in the B-2 District. 2. The Master and Final PUD process allows flexibility with the implementation of the City's subdivision and zoning regulations. 3. The proposal is not anticipated to adversely impact nearby properties through nuisance, noise, dust, glare, or unsightliness, and will not otherwise adversely impact the health, safety, and welfare of the community because the use is located in a commercial district, has been in operation since September 2008 and has not caused any adverse impacts, and will be aesthetically improved by the proposed landscaping improvements. 4. The proposal would not increase parking and traffic on the site compared to existing conditions. In addition, Northwestern College intends to continue shuttle service between the property and the College. 5. The proposal is in keeping with many of the principles of the Guiding Plan for the B-2 District due to the existing configuration of the site, and the addition of Lot 2 as a development opportunity in the B-2 District. 6. The proposal does not advance the principles of the Guiding Plan for the B-2 District, because it inhibits the realignment of the accesses on the site, the design standards for new construction are not being met, and the orientation of the development does not include a green space. 7. There are no delinquent property taxes, special assessments, interest, or City y utilit fees due upon the subject parcel. The building to be used will be upgraded to meet all applicable building and fire codes. 9. Each room will have its own bathroom. 10. The capacity of the building will not be exceeded. 11. The institutional housing will be for student housing only. 12. A regularly scheduled shuttle will be provided to and from the college. Planned Unit Development Review Findings: 13. Lot size,building and landscape coverage, and setbacks are met by the proposed plans. 14. All parking lot and landscaping requirements are met or exceeded with the exception of square footage of perennial/shrubbery plantings and parking lot islands. 15. The design standards that can be applied to this application are substantially met by the proposed plans. 16. Required number of parking stalls is exceeded by the proposed plans. 17. The project is subject to park dedication requirements. Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within three-hundred fifty (350) feet of the subject property. Public Comments The City has received one email from a resident regarding this application (Attachment D) Staff Recommendation Staff recommends approval of Planning Case #10-009 for a Zoning Code Amendment, Preliminary and Final Plat, and Master and Final PUD at 1201 County Road E subject to the following conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Northwestern College shall continue to provide adequate shuttle service, subject to the discretion of the City, between the College and Arden Hall during the regular school year until such time when the property is no longer utilized as a student housing facility. 13. The building occupancy of the existing building on Lot 1 shall not exceed the occupancy limit as determined by the Building Official and Fire Marshal or 350 students, whichever is less. 15. The on-site food service facilities within the existing building on Lot 1 shall be limited to use by students and staff of Northwestern College. 16. Northwestern College shall require parking permits for the users on the site and not allow commuter parking. Northwestern College shall be responsible for monitoring parking on the site. 17. Over the past two years in which NWC has occupied Arden Hall we have learned/discovered the following: Arden Hall has functioned extremely well for the college. - Arden Hall has had minimal impact on traffic and fever fire/police calls. Business community has access to reliable student employees. - Arden Hall requires significant long term investments—fire sprinkling, elevator upgrades, boiler, interior and exterior upgrades. Financing is extremely difficult to obtain and therefore new development of any type is challenging at best for the developer or for NWC. The B-2 General Business District encompasses a primary gateway into the City. The aesthetic and transportation impacts from new developments and redevelopments must be evaluated to help ensure the long-term viability and success of the B-2 District. Accomplishing the purpose of the B-2 District requires particular concern for the design of buildings, site features (such as landscaping, lighting, and signage), site layout, building materials, site design, and other related design elements. To that end, new development and redevelopment shall conform to the standards in this and related zoning requirements. The "Guiding Plan for the B2 District" shall act as a guide for development but is not part of the Zoning Code. In reviewing and approving land use applications, the City Council shall make the final determination on the compatibility and consistency with all provisions in this and related sections of the Zoning Ordinance. (Revised 121312008) Subd. 1 Procedure. To further accomplish the stated purpose of the B2 District, the following procedures shall be used: A. Modifications to these requirements may be granted by the City without a variance through the PUD process. Conditional use permits may also be required for uses list in Section 1320.05. B. Conditional Use Permits, Site Plans, and other development agreements that were approved for development sites before November 24, 2008, shall remain in effect but shall use the Planned Unit Development Process for future site amendments. - C. The following items shall not be considered significant modifications to an existing site and shall be exempt from the PUD process but shall be subject to administrative review and approval: -(i) Internal alterations to buildings that do not result in a change to the building height, roof line, or footprint unless the changes will have a notable increase in traffic and/or parking needs as determined by the Community Development Director or their designee; (ii) Replacement, maintenance, or repair of existing materials, including exterior finishes, signage, landscaping, and parking lots; (iii) Minor modifications to the exterior of a building or a site that substantially conforms to the design standards in Section 1325 and has no discernable impact on traffic as determined by the Community Development Director or their designee; D. The provisions in this Section may be modified by the City Council to allow planning flexibility without the need for a variance to encourage cooperative dialogue between the applicant and the City. Minor improvements to existing uses should be encouraged without costly upgrades or complete changes to a site. Subd. 2 Uses. A. Permitted uses (as specified in the Land Use Chart, Section 1320.05, for the B-2 District) that occupy existing buildings do not require a conditional use permit prior to occupancy. Other city permits may be required. B. Conditional uses (as specified in the Land Use Chart, Section 1320.05, for the B-2 District) require an approved conditional use permit prior to occupancy. Other city permits may be required. C. The following land uses are not compatible with the stated purpose of the B-2 District and shall be prohibited: Section 1320—District Provisions Adopted:November 13,2006 Page 19 of 63 City of Arden Hills Chapter 13 Zoning Code (i) Individual retail businesses larger than 50,000 square feet except for Sports and Fitness Clubs. (ii) Open sales, rental or storage lots, including but not limited to cars, buses, trucks, motorcycles, bicycles, recreational vehicles, trailers, boats, mobile homes, machinery, lumber, building materials, and similar items. Approved open air garden centers shall be exempt. (iii) Mini-storage facilities; (iv) Tattoo parlors; (v) Consumer Small Loan establishments; -- (vi) Outdoor bulk storage buildings, including but not limited to, forest, metal, concrete, agricultural and petroleum products, chemicals and similar products; and, (vii)Manufacturing or processing that generates hazardous waste without a valid Hazardous Waste Generator's license from the Ramsey County Public Health Department. Subd. 3 Special Regulations for Drive-up Windows, Drive-in Businesses and Fast Food Restaurants. Section 1325.04 of the Zoning Ordinance specifies additional requirements for drive-in businesses, fast food restaurants, and automobile service stations. For the purposes of the B2 District, these regulations shall also apply to drive- up windows. The provision whereby the proximity requirement of one thousand three hundred and twenty (1,320) feet between drive-in businesses, fast food restaurants, and drive-up windows may be waived if the following conditions are met as determined by the City Council: A. The architectural treatment, circulation plan, and signage system of such businesses shall be designed to visually and functionally integrate the building and the site on which it is located. B. The applicant shall submit a circulation plan that demonstrates that the use will not interfere or reduce the safety of non-motorized movements, specifically pedestrian and bicyclists. C. Requested modifications to the provisions in section 1325.04 shall be stated in writing along with an explanation of why the modifications would be in the public interest and would be consistent with the purpose of the B-2 District. Subd. 4 Hotel/Motel Additional Conditional Use Permit Criteria. Meet building code requirements; B. Entrance to each room shall be from an indoor corridor; C. Landscaping shall be brought into conformance with section 1325.05 Subd 1. The standards in section 1325 shall apply. 1320.09 Special Requirements for the B-3 Service Business District. The aesthetic and transportation impacts from new developments and redevelopments must be evaluated to help ensure the long-term viability and success of the B-3 District. Accomplishing the purpose of the B-3 District requires particular concern for the design of buildings, site features (such as landscaping, lighting, and signage), site layout, building materials, site design, and other related design elements. To that end, new development and redevelopment shall conform to the standards in this and related zoning requirements. In reviewing and approving land use applications, the City Council shall make the final determination on the compatibility and consistency with all provisions in this and related sections of the Zoning Ordinance. (Revised 12/17/2008) Subd. 1 Procedure. To further accomplish the stated purpose of the B3 District, the following procedures shall be used: A. Proposals for new construction, redevelopment of a site, and significant modifications to existing sites shall use the Planned Unit Development (PUD) process. We want our city leaders to have a vision for the city that is cohesive,and in that vision the knowledge of who its residents are and the needs of those residents, not a fragmented use of properties just to get something in. When visiting other local cities we see where sundry of uses were allowed in years past,then finally the cities implemented planned development with exemplary results.The city of Arden Hills has an opportunity to commit to planned development in the present and in the future,a blank slate if you will, not to follow how actions were taken in the past, not to react to a first proposal such as this. One example of a community use for the NW corner of County Road E and Lexington Avenue,and one we feel would draw residents and visitors to our downtown area and perhaps solve the library location issue, is a facility such as Woodbury Central Park. General Zoning Regulations A. Height— (Section 1325.09 Subd 5)—Meets Requirements According to the Zoning Code,no antenna or tower shall exceed a height of 75 feet. The height of the proposed antennas would be approximately 56 feet. B. If this is established the Zoning Code lists alternate locates, in order of preference, for antennas. The first preference for the City, after City water tower sites, is existing towers or structures located within any Industrial, Civic-Center, or Business District zoned property. The applicant has submitted a letter addressing the location criteria in reference to the Red Fox Road City water tower site, indicating that this is not a feasible location. In addition, the City contracted with OWL Engineering to provide an independent coverage analysis of the proposed plans compared with the City water tower sites (Attachment Q. According to the August 19, 2010, report the OWL Engineer states that the proposed communications site eliminates a gap in in-building coverage and the use of the existing City water tower would not eliminate the gap in coverage for the AT&T system in the Bethel University area. Therefore, AT&T has proposed locating their antennas on an existing structure within the Bethel University campus, in accordance with the - requirements of the City Code. According to the Zoning Code, antennas and towers shall be located on sites or buildings in areas that are least obtrusive to nearby properties and public streets. The proposed antennas would be located approximately 1,185 feet from the nearest property line on the roof of the Brushaber Commons building. The roof of the building is not visible outside the Bethel University campus. All other location requirements of Section 1325.09 are met by the proposed plans. C. Screening(Section 1325.09 Subd. 7) —Meets Requirements The Zoning Code requires antennas to be painted to match the color of the structure to which they are attached. The antennas themselves will not be visible, as they are located inside of an antenna assembly canister; however, the canister will be painted to blend in with the equipment that it is attached to. 2. B-1 Zone Regulations—Meets Requirements Cellular towers and antennas are permitted as a conditional accessory use in the B-1 Zoning District. 3. Conditional Use Permit—Section 1355.04 Subd 3—Meets Requirements Section 1355.04 Subd 3 of the Arden Hills Zoning Code lists the criteria for evaluating a Conditional Use Permit. The Planning Commission and City Council shall consider the effect of the proposed use upon the health, safety, convenience and general welfare of the owners and occupants of the surrounding land, in particular, and the community as a whole, in general, including but not limited to the following factors: 1. Orderly development of the neighborhood and the City within the general purpose and intent of this ordinance and the Comprehensive Development Plan for the City. 4. Additional Review The City Public Works Director and Building Inspector have reviewed the project and have _ not expressed any objections to the proposal. Findings of Fact The Planning Commission must make a finding as to whether or not the proposed cellular tower and equipment shed meets the requirements of the Zoning Code and if they would adversely affect the surrounding neighborhood or the community as a whole. Staff offers the following fourteen findings for consideration: General Findings: 1. Documentation has been submitted that addresses the use of the City"s water tower sites. This documentation indicates that the water tower sites would not meet the location needs to provide coverage in this area of the City. 2. The proposed antennas would be located on an existing structure. 3. The proposed antennas would be located within the B-1 —General Business District Zone. 4. The proposed antennas would be at an approximate height of 56 feet. 5. The antennas would be located approximately 1,185 feet from the nearest property line. 6. The canisters would be painted to match the color of the structure to which they are attached. 7. Cellular towers and antennas are a conditionally accessory use in the B-1 Zoning District. On the Conditional Use Permit Evaluation Criteria: 8. The proposed plan would not have any impact on traffic or parking conditions. 9. The proposed plan will not produce any permanent noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, and other nuisance characteristics. 10. The proposed plan will not impact drainage. 11. The proposed plan will not impact population density. Park dedications are not applicable. 14. The proposed plan does not conflict with the general purpose and intent of the Zoning Code or the Comprehensive Development Plan for the City. Notice Notice was published in the Arden Hills/Shoreview Bulletin and notice was prepared by the City and mailed to residents within three-hundred fifty(350) feet of the subject property. Public Comments At this time the City has not received any comments from the public regarding this project. Staff Recommendation Based on the findings, Staff recommends approval of Planning Case#10-010 for a Conditional Use Permit at 3900 Bethel Drive subject to the following five conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. A Conditional Use Permit drafted by the City Attorney shall be signed by the applicant prior to the issuance of any building permits. 3. A building permit shall be obtained for all proposed antennas prior to installation. 4. A building permit shall be obtained for all proposed structures prior to installation. 5. The antenna assemblies are proposed to be mounted on the roof on top of an expanded HVAC screen-wall. The ground equipment shelter is proposed to be located at the north end of Brushaber Commons. The shelter will have a brick exterior to match Brushaber Commons and is designed aesthetically to appear as though it is a planned part of the existing building. (Please see photo-simulations attached as Exhibit 4). The proposed facility will allow AT&T Mobility to provide_quality in-building wireless voice and data service to Bethel University and this portion of Arden Hills. AT&T has received numerous complaints from Bethel University students about unacceptable in-building coverage and AT&T has measured signal strength within the university confirming the problem. A university campus is unique in that there are numerous large brick buildings that house students and faculty for the primary purpose of education. Most students use a variety of wireless devices daily for educational research and communicating. The proposed AT&T facility will ensure that the campus is covered with sufficient system capacity and signal strength to provide coverage within the majority of the campus buildings. It is important to note that in order to ensure adequate signal strength and capacity within a university campus, a wireless facility needs to be located within the campus, if at all possible. This is due to the high concentration of users in a relatively small geographic area and the number of buildings, (most of which are of brick construction) which tends to attenuate the wireless signal. The improved AT&T coverage will also enhance public safety for Bethel University students, faculty and emergency service responders. Chapter 13 of the Arden Hills Code requires that wireless facilities be located on municipal water tower structures unless the applicant shows, to the reasonable satisfaction of the City, that none of the water tower sites can be feasibly used from an engineering standpoint. The closest water tower site to Bethel University is located approximately %a mile east of the center of the Bethel Campus at 1260 Fox Road. Even though this water tower is fairly close to the campus, it is located on high ground(945ft AMSL) as compared to the lower average ground elevation of the buildings located within the Bethel University campus (900ft AMSL). This elevation change, along with the existing trees and buildings located between the water tower and the central part of the campus attenuate the signal to the point that an AT&T facility.located on the Fox Road water tower cannot provide sufficient and reliable in-building coverage to the majority of the Bethel University campus. In particular, the numerous buildings located in northwest portion of the campus and on the west side of the campus would not have sufficient and reliable in-building coverage for voice and data wireless devices. AT&T is currently a tenant on the Arden Hills Water Tower located 1 mile to the North of I-694. This existing AT&T facility does not provide reliable in building coverage on campus. Additionally, it is our understanding that City Staff will be having Owl Engineering review this application and AT&T's network in this portion of Arden Hills. A copy of this report should be available for the Arden Hills Planning Commission and City Council to review prior to the public hearing and council meeting. It seems as though everyone is carrying at least one cell phone these days. They are so much a part of the student culture that we are in the process of removing desk and wall phones from our residence hall rooms. It has become clear to us that our students simply do not use land lines. As in the old days one wall phone will service an entire residence hall. However, our students,we suspect, will be more engage than ever before because of the ubiquitous cell phone. Although cell phones are everywhere they do not always work as well as we would like. Whether it is due to the topography of the Bethel campus,the large buildings of concrete and steel or a combination of the two, cell phone coverage is a significant issue. I regularly receive complaints from our student government that we need to do something about coverage on campus. In addition to the mere convenience of being able to talk to friends or mom and dad, the cell phone has also become our emergency communication link with our students. In response to the highly visible and tragic incidents on college campus'over the past several years we have instituted an emergency alert system that relies heavily on cell phone communication. In the event of a crisis on the Bethel campus most students would learn of the incident and what to do by following instructions on their cell phones. This is no longer about connecting with your friends but takes on a far more serious tone. At Bethel we are always conscious of the aesthetic implications that any new structure will have on the overall campus appearance. In this instance the location on the Brushaber Commons made it even more imperative that it be done well. To ensure we are not making a mistake I have had Dr. Wayne Roosa,art historian and art department chairperson, review the design and its implications. In addition to his academic responsibilities Dr. Roosa has been a involved in every major building project since 1994. Dr. Roosa is comfortable with the proposed antennae and its stealth covering as something that will not disrupt or obtrusively alter the campus aesthetic. The requested information was provided and the data was analyzed. This analysis shows how AT&T has designed its communications facilities in the Arden Hills area with several surrounding sites providing area wide coverage. In discussions with AT&T engineers it was noted that the design of their system differed from ordinary system designs in that the college campus has many buildings that presently have very poor in-building coverage. The proposed site is intended to give good coverage within the campus area. An area of concern expressed by the city was to determine if an existing water tower could be used to provide the required coverage area for the AT&T communications system. In reviewing the location of the water tower and the communications facilities locations, the water tower to the west is too far from the proposed new AT&T site and - cannot provide the required coverage area to eliminate the signal coverage gap. Figure 1 shows the location of the proposed site and the water tower (WT). On August 18, 2010 measurements were taken on the Bethel Campus to verify the existing coverage area and also to determine the in-building signal attenuation to use in the coverage study computer model Figure 2 shows the results of the coverage study analysis using the data for this proposed site in addition to the data supplied by AT&T for the nearby system sites. The analysis was then repeated with the proposed site removed from the analysis in order to determine if there is any gap in coverage in the AT&T system in the proposed coverage area. Figure 3 shows that a gap in coverage does exist and is identified. The analysis was repeated using the water tower (WT) as the location of the communications system.
