SUBJECT: Lexington Avenue Sidewalk Projects - Award Bid
Back�round
On July 26, 2010, the City Council authorized a consultant contract with MFR.A, Inc. to
complete engineering and construction services for the sidewalk and trail improvements
along Lexington Avenue. The proj ect is composed of the following two separate
sidewalk/trail segments:
• Trail A: Existing bituminous trail rehabilitation from County Road F to Cummings
Park Drive
• Trail B: New concrete sidewalk from the CP Rail to Grey Fox Road
The plans and specifications were completed and the City solicited bids during August
and early September. Five bids were received and opened on September 9, 2010. Based
on the bids received, staff recommends awarding the proj ect.
Discussion
Based on past practice, the City Council has awarded the contract to the lowest
responsible bidder. In the case of the Lexington Avenue Sidewalk Project, the lowest
bidder is North Valley, Inc. of Elk River, Minnesota.
Financial Implications
Construction:
The City received five bids for the proj ect. As mentioned, the construction proj ect is
composed of two sidewalk segments and contractors separated their submitted bids into
Trai1 A and Trail B subtotals. The lowest total bid submitted by North Valley,
$90,011.62, is 13% lower than the engineer's construction estimate of $103,219.85. The
following is a list of the bids received:

Construction En�ineerin�
The City has contracted with MFR.A, Inc. for engineering services through the design and
construction phases for a total amount of $16,970. It is estimated that Roseville
engineering services will be $2,600.
Fundin� S ources :
This proj ect is budgeted to use PIR Funds and special assessments. For the special
assessments, the City has entered into an agreement with Inland Shannon Square Cub,
LLC and Inland Shannon Square Shoppes, LLC in which they will each pay for one-
quarter (1 /4) of Trail B construction and engineering services. The amount each entity
will be assessed is $13,500; for a total assessment of $27,000. This amount includes
construction costs, engineering fees, and legal fees. Staff has contacted Inland Properties
to provide them the bid results and the proposed assessment amount, as outlined in the
terms of the agreement. At the time the council packet was distributed, staff had not
received a response whether the amount is acceptable to Inland Properties. The proposed
assessment amount is lower than was estimated during earlier discussions with Inland
Properties.
Timeline:
Construction is estimated to last approximately two to three weeks and the specifications
state 4ctober �9, 2010 as the mandatory completion date. It is anticipated that
construction will begin in early October.
Council Action Requested
Approval of Resolution 2010-050: Awarding the Lexington Avenue Sidewalk Project to
North Valley, Inc. of Elk River, Minnesota, in the amount of $90,011.62, contingent upon
Inland Properties' consent to the amount to be assessed.

The low bidder, North Valley, made a clerical error on the mobilization item that if strictly enforced would reduce
their bid price by $2,249.50. The intent of the bid was clear and it was apparent that a clerical mistake was
made, Their clerical error does not change the bidde�s low bid status.
MFRA recommends that the City Council awards the contract to North Ualley in the amount of $90,011.62, North
Ualley is a well qualified contractor and we have worked with them on many successful projects.

A RES4LUTION AWARDING THE LEXINGT4N AVENUE SIDEWALK PROJECT
WHEF�.EAS, pursuant to advertisement for bids for the improvement of the
Lexington Avenue Sidewalk Project, bids were received on Thursday, September 9, 2010, at
10:00 a.m., opened, and tabulated according to the law, and the following bids were received
complying with the advertisement:

N4W THEREFORE, BE IT RESOLVED BY THE CITY CUUNCIL OF ARDEN
HILLS, MINNESOTA:
l. The Mayor and City Administrator are hereby authorized and directed to enter into a
contract with North Valley, Inc. of Elk River, Minnesota, for $90,011.62 in the name of
the City of Arden Hills for the above improvements according to the plans and
specifications thereof heretofore approved by the City Council and on iile in the office of
the City Administrator.
2. The City Administrator is hereby authorized and directed to return forthwith to all
bidders the deposits made with their bids, except that the deposits of the successful bidder
and the next lowest bidder shall be retained until contracts have been signed.
