<br />THIS EASEMENT AGREEMENT ("Agreement") made this day of
<br />0 6 a , 201 by and between Rodney W. Hoheisel, a single person, "Grantor" and the
<br />CITY OF CENTERVILLE, a municipal corporation organized under the laws of the State of
<br />Minnesota, as Grantee, hereinafter referred to as "City".
<br />WITNESSETH:

<br />The Grantor, in consideration of the sum of One Dollar ($1.00) and other good and
<br />valuable consideration to them in hand paid by the City, the receipt and sufficiency of which is
<br />hereby acknowledged, do hereby grant and convey to the CITY OF CENTERVILLE, its
<br />successors and assigns, forever, a perpetual easement for public utility purposes over, across, on,
<br />under, and through land situated within the County of Anoka, State of Minnesota, legally
<br />described on the attached Exhibit A ("Permanent Easement Premises").
<br />INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
<br />upon the Permanent Easement Premises at all reasonable times to construct, install, reconstruct,
<br />inspect, repair, and maintain the public utilities over, across, on, under, and through the
<br />Permanent Easement Premises, together with the right to grade, level, fill, drain and excavate the
<br />Permanent Easement Premises, and the further right to remove trees, bushes, - undergrowth, and
<br />other obstructions interfering with the construction, installation, maintenance, inspection and
<br />repair of the drainage system and public utilities. The City agrees by accepting this Grant of
<br />Permanent Easement that if, during any construction, reconstruction, maintenance, inspection or
<br />repairs of the public utilities, at its sole cost and expense will restore the property to a condition
<br />as nearly equal as reasonably possible to what previously existed, however no trees, shrubs or
<br />other special landscaping features will be replaced.
