City of Centerville <br />Comicil Meeting Minutes <br />October 27, 2010 <br />VIM NEWBUStNESS <br />Review Bids and Consider Award of Contract for Downtown Storm Water <br />Reclamation Pro] ect —Phase I <br />a. Contract A <br />b. Contract B <br />C. Contract C <br />City Engineer Statz reviewed the bid results for the downtown storm water reclamation <br />project phase 1. He reviewed Contract A, Contract B, and Contract C. <br />City Attorney Glaser stated the lowest bidder for Contract C did not submit a bid security <br />check or bond. He added, because of the omission of the security check/bond, the City is <br />not obligated to take the lowest bid and added there is a risk in taking the lowest bid. <br />Motion by Council Member Fehrenbacher, seconded by Council Member Love to <br />Approve Res. #10-028 - Awarding Contract for Downtown Storm Water <br />Keclamation project — Phase 1, Contact A base bid. All in favor. Motion carried. <br />unanimously. <br />Motion by Council Member Love, seconded by Council Member Paar to Approve <br />Res. #10-029 - Awarding Contract for Downtown Storm Water Reclamation Proiect <br />— Phase 1, Contact B. All in favor. Motion carried unanimously. <br />Motion by Council Member Fehrenbacher seconded by Council Member Love to <br />Approve Res. #10-030 - Awarding Contract for Downtown Storm Water <br />Reclamation Prolect — Phase 1, Contact C Irrigation System. All in favor. Motion <br />carried unanimously. <br />2. Resolution 101-027: AD Droving Joint Settlement Aareement and Stipulation for <br />Dismissal with Preiudice, <br />City Attorney Glaser reviewed background information regarding the Joint Settlement <br />Agreement and Stipulation for Dismissal with Prejudice in the amount of $3,852.00 for <br />trail easement procurement with Mr. David Fisher, 7072 Centerville Road. <br />Motion by Mayor Capra, seconded by Council Member Fehrenbacher to AppLove <br />Res. #101-027 - Joint Settlement Agreement and Stipulation for Dismissal with <br />Prejudice in the amount of S3,852.00, as recommended by the City Attorney.
