inaccuracies, errors, and/or omissions may occur in the information available through #he STAR <br /> System. • <br /> B. Furthermore, the Municipality specifically understands and agrees that the <br /> services furnished under this Agreement are subject to the temporary or permanent inability of <br /> the County to furnish either, and are also subject to errors, omissions, damages, reductions, <br /> discontinuances, malfunctions, inoperativeness, scheduled downtime, delays or interruptions <br /> which may be due to any one or a combination of a wide spectrum of causes. While the County <br /> shatl endeavor in good #aith to maintain a high degree of accuracy and efficiency for the services <br /> provided hereunder, the sole and exclusive remedy for any breech of this Agreement by the <br /> County and for County liability at any time whatsoever, including but not limited to liability or non- <br /> performance for any de�ciencies with respect to said services, shall be limited to diligently <br /> restoring the services andlor deficiency of said service. <br /> C. The information furnished through the STAR System has been and shall be <br /> obtained from the County's records and is believed to be reliable. However, the accuracy, <br /> completeness, timeliness or correct sequence of the information is not guaranteed by the <br /> County. There may be delays, interruptions, omissions or inaccuracies in the �eceipt of public <br /> information. The Municipality agrees that the County shall have no liability, contingent or <br /> otherwise, for the accuracy, comp{eteness, time{iness or correct sequencing of the data or for <br /> any decision made or action taken by the Municipality o� anyone who receives information from <br /> the Municipality and acts in reliance upon the data. THERE IS NO WARRANTY OF • <br /> MERCHANTABILITY, NO WARRANTY OF FITNESS FOR A PARTICULAR USE, AND NO <br /> WARRANTY OF ANY �IND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY OR <br /> RELIABILITY OF INFORMATION OR ANY ASPECT OF THE SERVICE PROVIDED HEREIN. <br /> VI. TAXES <br /> The Municipality agrees that du�ing the term of this Agreement, in addition to the fees or <br /> other charges provided herein, the Municipality shall promptly pay all taxes, assessments, and <br /> other governmental charges, if any,levied or assessed upon the services fiumished hereunder to <br /> the Municipality, and the Municipality shall promptiy pay or reimburse the County for all taxes <br /> levied or assessed against and paid by the County on account of its furnishing services to the <br /> Municipality hereunder. <br /> VII. TERMINATION <br /> This Agreement may be terminated by either party at any time, with or without cause, <br /> upon not less #han one (1) year written notice delivered by mail or in person to the other party. If <br /> notice is delivered by mail, it shali be deemed to be received two days after mailing. <br /> -4- • <br /> 32 <br />
