<br />PUBLIC HEARING NOTICE <br /> <br />Tuesday, December 14, 2010 <br />Commencing at 6:30 p.m. or Shortly Thereafter in Council Chambers <br /> <br />FOR RESIDENT INPUT ON PROPOSED MODIFICATIONS OF CITY CODE & <br />VARIANCE REQUEST <br /> <br />NOTICE IS HEREBY GIVEN that the Planning and Zoning Commission of the City of <br />Centerville, Minnesota will be meeting and considering resident input regarding proposed <br />City Code modifications to Chapter 153, Section 153.44, J, Chapter 156, Section <br />156.030, K, and Section 156.040, N and a variance request for 1540 Peltier Lake Drive to <br />be allowed to construct an accessory structure on an existing cement slab with footings <br />encroaching the required set back. The amended language is as follows: <br /> <br />Chapter 153, Section 153.44, J <br /> <br />ADDING NEW LANGUAGE: Hydro-seeding may be substituted for sod subject to: 1) <br />Two rows of sod shall be placed along the curb and any other adjoining pavements, <br />erosion control as approved by the Building Official shall be placed at the property lines <br />and next to water features. 2) An automated in-ground irrigation system shall be in place <br />and 3) the site deposits shall be retained until the vegetation is fully established. This <br />shall not prevent a developer from establishing lot covenants requiring sod, in which case <br />this substitution shall not be allowed. <br /> <br />Chapter 156.030, K <br /> <br />ADDING NEW LANGUAGE: (16) – (19) Reserved and (20) Uses not explicitly <br />enumerated in this section as permitted uses, but closely similar thereto as determined by <br />the Planning and Zoning Commission, provided these uses are not explicitly mentioned <br />as permitted or conditional uses elsewhere in this Chapter. <br /> <br />Chapter 156.040, N <br /> <br />ADDING NEW LANGUAGE: (6) – (19) Reserved and (20) Uses not explicitly <br />enumerated in this section as permitted uses, but closely similar thereto as determined by <br />the Planning and Zoning Commission, provided these uses are not explicitly mentioned <br />as permitted or conditional uses elsewhere in this Chapter. <br /> <br />VARIANCE REQUEST: To construct a 20’ x 32’ accessory (detached garage) structure <br />on an existing cement slab where a previous structure existed prior to the <br />construction/widening of CSAH14. The homeowner desires to utilize the existing <br />cement slab which currently does not meet set back requirements. <br /> <br />The City Hall is ADA accessible. Requests for hearing assisted devices or a sign <br />language interpreter must be received before 4:00 p.m., December 10, 2010. All persons <br />interested are invited to attend and to be heard, verbally or in writing.
