Planning & Zoning �ommission Findings and Recommendation for Denial <br /> The Planning Commission met on December 14, 2010, to consider a request of Derek <br /> Gavin, 1540 Peltier Lake Drive, for a variance to allow a garage setback of five feet from <br /> I the Main Street side property Iine, rather than the normal twenty feet. <br /> Findings: <br /> 1) The applicant proposed to reuse an existing concrete slab to construct a new garage <br /> with doors facing Peltier Lake Drive. The building previously had a driveway facing <br /> Main Street (CSAH 14), but that driveway was closed by Anoka County in the road <br /> reconstruction. <br /> ' 2) Upon further examination it was determined that the slab did not have adequate <br /> thickness at the edges to meet current code requirements for a floating slab and <br /> therefore would have to be substantially if not completely reconstructed. Due to this <br /> fact, there would not be anything preventing the new canstruction from being placed <br /> in a location that meets current setback regulations. <br /> 3) The applicant did not provided evidence that the property could not be put to a <br /> reasonable us without a variance. <br /> 4) The Commission finds that the property can and is being put to a reasonable use as <br /> evidencecl by the fact that a home exists on the property and further that adequate <br /> land exists to construct a garage in a location that meets current setback requirements. <br /> RECOMMENDATION <br /> The Planning Commission by motion duly passed, recommends that the variance be <br /> denied based upon the findings as stated. <br /> Planning and Zoning Commission <br /> Dallas Larson, Administrator <br /> � <br /> � <br /> , <br /> � <br /> I <br /> I <br /> 42 <br />
