<br />Plauning and Zoning Cnmmimrinn <br />Meeting Minutes <br />January 4,2006 <br />Mr. W'tlharber indicated the Church is looking for a variance from the setback <br />requirements of20 feet. <br /> <br />Chair Hanson asked how the property owner to the east feel about this. <br /> <br />Mr. W'1lharber indicated he is not pleased with it being there and explained that he has <br />been keeping him informed and asking if he has questions but rather than discuss it with <br />the Church he has called the Mayor and he has not been willing to discuss the matter with <br />the Church. <br /> <br />Commissioner Klennert Hunt indicated that she sees the road is close to the house but it <br />would be terrible if the road would have to jog. She then said that the safety of the <br />intersection is important. <br /> <br />Mr. Wilharber indicated that there are 410 families that belong to St. Genevieve's and it <br />continues to grow. <br /> <br />Motion bv Commissioner Ran7.a1. seconded bv Conunissioner Wriut to set a DubHe <br />hearine: for Februarv ~006 for Sf. B & R Properties - 6805 - 20th Avenue Request for Rezone <br /> <br />Ray Olson of B & R Properties appeared before the Commission and asked for <br />clarification of the zoning of his property. <br /> <br />City Administrator Larson explained that in the Comprehensive Plan this property was <br />zoned B 1 in 1997 but until very recently it was industrial zoning on the zoning map and, <br />the Comprehensive Plan takes precedence over the zoning map so, during housekeeping <br />items held last summer this was one to make the zoning map match the Comprehensive <br />Plan. He then explained that Mr. Olson's Bank has asked for a zoning letter as part of its <br />financing requirements and, as a B 1, they would be a legal nonconforming use in this <br />area so he could not expand and, if this is industrial not business, that expansion may not <br />be appropriate but it has been industrial in its use for a long time. <br /> <br />Commissioner Wood said he appreciates the changes done at this location and he does <br />not feel that rezoning would be an issue at this time. <br /> <br />Chair Hanson indicated he feels that the City is obligated to allow the use to be there and <br />do either a special use permit or rezone the property as this went through the steps with <br />the City and was approved. <br /> <br />city Administrator Larson indicated that a public hearing for rezoning and a <br />Comprehensive Plan amendment would be necessary to fix the situation. <br /> <br />Page 3 of5 <br />
