Draft Draft Draft <br /> .......................................... ............................... <br /> Findings and Decision Related to Code Amendments Regulating Variances <br /> The Planning & Zoning Commission met on August 9, 2011, to consider proposed <br /> changes to the city code that would modify the requirements for allowing variances. <br /> Findings: <br /> 1) The Minnesota Supreme Court in its decision in the Krummenacher v. City of <br /> Minnetonka, severely limited the City's authority to grant zoning variances. <br /> 2) The 2011 Legislature passed legislation that enables cities to once again consider <br /> reasonable factors in granting variances. <br /> 3) The City staff drafted proposed changes to City Code Chapter 156, Section 156.310 <br /> which implement the authority on variances allowed by the new legislation. <br /> 4) The Planning & Zoning Commission held a public hearing on this date to consider the <br /> proposed changes to Chapter 156, and the Commission considered public comments <br /> regarding the proposed changes. <br /> RECOMMENDATION: <br /> The Planning and Zoning Commission determines that the proposed amendments to <br /> Chapter 156 providing for standards to issue zoning variances, should be adopted <br /> The Commission recommends that the council approve findings and recommendations of <br /> the Commission and that the attached ordinance be adopted. <br /> Approved by the Planning & Zoning Commission of the City of Centerville on August 9, <br /> 2011. <br /> 16 <br />
