SECTION 8, cont. <br /> SIDEWALKS, cont. <br /> IMPROVEMENT Polciy: Pursuant to Minnesota Statutes <br /> DISTRICT 435.44, the City Council by ordinance <br /> may establish a sidewalk improvement dis- <br /> trict. The purpose of such district is <br /> to provide an area with safe pedestrian <br /> walkways to and from schools, school bus <br /> stops, public transportation facilities, <br /> and other neighborhood and community <br /> facilities. Improvements may include <br /> both construction and repair. <br /> Assessable Cost: The Council may elect to <br /> make all or part of the project costs <br /> assessable costs. <br /> Distribution of Assessments: The assessable <br /> cost may be apportioned to all property in <br /> the district on a uniform basis as to each <br /> classification of property. An indirect <br /> benefit assessment may involve all property <br /> in the district without regard to location <br /> of sidewalks; a direct benefit may be <br /> assessed to abutting property for the <br /> additional cost of an extra sidewalk width. <br /> Assessments may be spread over a five- <br /> year period. <br /> SECTION 9 <br /> POSTPONED ASSESSMENTS <br /> 1. If the city advances its own funds to pay for improve- <br /> ment costs relating to property abutting on but not initially <br /> assessed for the improvement, the City may reimburse itself <br /> for all or any portion of this cost by levying assessments <br /> against such property upon notice and hearings provided for <br /> the assessments at a later date. <br /> 2. If the City advances its own funds to pay for improve- <br /> ment costs that benefit non - abutting property not initially <br /> assessed for it, but able to use it when extensions or other <br /> improvements are made, the City may include all or any por- <br /> tion of the costs originally advanced into assessments for <br /> later improvements if notice to that effect is included in <br /> the notice of hearing on the matter of undertaking the later <br /> extension or improvement. <br /> 13 <br />
