Green Consulting Engineers <br /> Greg Hellings, City Attorney <br /> CALL TO ORDER <br /> Mayor Wilharber called the Council meeting to order at 6:00 p.m. <br /> PUBLIC HEARING <br /> APPEARANCES <br /> NSP Gas Franchise <br /> Mr. Hellings gave an overview of Northern States Power Company's (NSP) request for a gas <br /> franchise. Furthermore, in order for a public utility to utilize a public right -of -way, there must be <br /> a franchise agreement between Centerville and NSP. Currently, the City has a franchise <br /> agreement with Minnegasco. Mr. Hellings stated NSP's agreement is typical of a public utility <br /> contract. However, utility companies usually allocate 3 to 7 percent for franchise fees to Cities. <br /> Mr. March commented NSP has requested to provide gas service from east of 35W to the <br /> undeveloped industrial area in Centerville. Mr. March added some concerns he had with the <br /> contract, if the governing body adopts an ordinance in the future, NSP is exempt. Mr. March <br /> noted developers have requested NSP and there is no interest in competing with Minnegasco. <br /> However, Mr. March recommended denying the franchise agreement. <br /> Mr. Hellings stated if gas line relocation is required within five years the City is responsible for <br /> paying the cost. <br />
