Mr. <br /> March explained the burden of proof lays on the Council and the engineer, to fairly distribute the <br /> assessment cost. <br /> Mr. Jack & Ms. Joyce Green (7007 20th Avenue) expressed concern about saving the treeline and <br /> shrubs along their south property line. Mr. Nyberg noted one of the alternate bids (Bore <br /> Forcemain) cost $18,000 more to redirect the forcemain, which is cost prohibited. However, <br /> H.R. Green plans to explore other options to preserve the trees. <br /> Councilmember Buckbee clarified letters contesting the assessments and letters of appeal are to be <br /> submitted by the end of the public hearing. Mr. March suggested the Council consider continuing <br /> the public hearing until the next Council meeting, May 13, 1998. Mr. Nyberg emphasized H.R. <br /> Green tried to produce several alternatives to accommodate all parties involved. <br /> Councilmember Buckbee noted if the City elected to assess the area minus floodplain and a hook <br /> up was not available to 6885 -20th Avenue, then the Carpenters would not be assessed. Mr. <br /> Nyberg agreed, because the property is considered in a floodplain. <br /> Mr. Carpenter felt a stub should be put in place for future property use. Mayor Wilharber <br /> confirmed fill can be brought to the floodplain properties and then the land could be taken out of <br /> the floodplain. Therefore, the property value would increase and potentially be completely <br /> developed. Mr. Nyberg agreed. <br /> Moreover, Councilmember Buckbee stated if the Carpenters elected not to hook up now and in <br /> the future they bring in fill, they could be assessed then for the stated improvements. Mr. Nyberg <br /> agreed. Councilmember Buckbee concluded this would place the assessment burden on the larger <br /> property owners. <br /> Mr. Carpenter suggested the city place a connection to his property for future improvements. <br /> Then the cost would be off set when the property is brought up to code. <br /> Mr. Russel Strehlow (property legally identified as 24- 31 -22 -32 -0003) clarified the four <br /> assessment options and the Council's time line to elect an assessment option. Mayor Wilharber <br /> replied an appeal must be received by the City no later than 4:00 p.m. on Wednesday, May 13, <br /> 1998. <br /> Mr. Strehlow questioned, "Does the area minus floodpWn include wetlands ?' Mr. Nyberg <br /> replied no, the city has copies of the wetlands and they would not be included in the floodplain. <br /> Councilmember Brenner moved and it was seconded to continue the 20th Avenue <br /> 3 <br />
