Motion carried unanimously. <br /> Buechler Estates <br /> Park Dedication Fees - Preliminary Plat <br /> Mr. March introduced the Buechler Estate park dedication and preliminary plat issue. Moreover, <br /> Mr. Carl Buechler has requested to subdivide a parcel of property into four or five lots located off <br /> Mound Trail, According to the City's park dedication fee policy the Developer will need to pay <br /> $950 per lot or 10% of the price he is willing to pay for the property, whichever is higher. During <br /> the October 7, 1998 Park and Recreation meeting the committee discussed Mr. Buechlers request <br /> to lower the $50,000 park dedication fee. The Park and Recreation committee recommended that <br /> the Council make the decision on this issue and they will support the Council's decision. <br /> Mr. Buechler commented that he has been cooperative and has tried to work with the community. <br /> However, the proposed development consists of five lots and $10,000 park dedication fees per lot <br /> is too much to charge. Therefore, the Developer requested the Council to reconsider the $50,000 <br /> fee and lower the park fees. <br /> Councilmember Brenner did not agree with deviating from the ordinance because the City may be <br /> setting a precedence for future developers /developments. Mr. Buechler noted he could develop <br /> four lots instead of five. Then no park dedication fees would be required, and the City would lose <br /> out on the park fees and the tax base. Mayor Wilharber referred to the park dedication fee <br /> schedule for residential developments in the metropolitan area and recognized the majority of <br /> cities charge minimal park fees. Councilmember Buckbee requested 10% of the raw value land <br /> and requested the purchase price. Mr. Buechler did not disclose the purchase price for the <br /> property. <br /> Councilmember Brenner moved to deny Carl Buechler the request to pay $950 pa <br /> dedication fees per lot and to up hold the current ordinance for future developments. <br /> Motion failed for lack of a second. <br /> 3 <br />
