MN 55303 -2264 <br /> November 17, 1998 <br /> City of Centerville <br /> CIO Ry -Chel Gaustad <br /> 1880 Main St <br /> Centerville, MN 55038 <br /> Dear Mr. Gaustad: <br /> I am writing to remind City and Township officials in Anoka County about a new state requirement <br /> pertaining to Individual Sewage Treatment Systems (ISTS) regulation. <br /> According to recently enacted state statutes, by January 1, 1999, local government units must have adopted <br /> ISTS ordinances as restrictive as the current state rules (Minn. R. Chap. 7080). Anoka County adopted the <br /> current state rule, with some modifications, in January, 1998. Based on Minn. Stat. § 115.55 requirements, if <br /> a city or township has not adopted these provisions in its ordinance by January 1, 1999, then the county's <br /> ordinance applies within that city or township. This state law is attached as information. <br /> Anoka County is interested in working with those communities that have not adopted an ordinance with the <br /> current state rule provisions. We would encourage communities that regulate ISTS to adopt current state rule <br /> provisions as soon as possible. We also recognize that adopting the state rule before this deadline may not be <br /> possible in some cases. <br /> For communities that cannot meet this statutory deadline, an option might be a Joint Powers Agreement with <br /> the county under which the city or township acts to enforce the county ordinance while it works on adopting <br /> its own ordinance. If there is interest in this option, a proposed Joint Powers Agreement can be drafted for <br /> discussion and ct)n sideraccn by the City Counril or Town Board and the County Board. <br /> I would appreciate being contacted with status information on your community's ISTS ordinance and whether <br /> your community has interest in discussing a Joint Powers arrangement You can contact me at 612 -422- <br /> 7068.
