MEMO <br /> DATE: December 3, 1998 <br /> TO Honorable Mayor and Council <br /> FROM: Jim March <br /> RE Variance request for 7289 Mill Road (Robert Nepper) <br /> Included in your packet is a copy of the certificate of survey for the above mentioned property. A <br /> public hearing was held at the last Planning and Zoning Commission meeting. Also included in <br /> your packets are the minutes from the last Planning and Zoning meeting. The recommendation <br /> was to approve a 10' variance from the front setback only to the east property line. <br /> This variance did meet the four stipulations as outlined in Ordinance #4 for granting a variance. <br /> The property owner has received a variance from Rice Creek Watershed District to make the lot <br /> buildable as well as a letter of map amendment from FEMA. <br /> The purpose of the variance is to allow the front of the home to be more in line with adjacent <br /> properties, create a further setback from the creek and allow for the mature trees on the west side <br /> of the property to be saved. There was no one in attendance at the hearing. I spoke to the only <br /> adjacent property owner on the phone in regards to the variance request. This person may appear <br /> at the Council meeting. He had indicated to me that they did not have a problem with the <br /> variance request. <br /> I would recommend granting approval for this request. <br />
