RESOLUTION 97 -08 <br /> STATE OF MINNESOTA <br /> COUNTY OF ANOKA <br /> CITY OF CENTERVILLE <br /> A RESOLUTION DISSOLVING NORTH METRO RECREATION COMMISSION, <br /> WHEREAS, the Cities of Centerville, Circle Pines, Lexington and Independent School District <br /> #12, all located in the County of Anoka, State of Minnesota, entered into a Joint Powers <br /> Agreement on April 11, 1991, establishing the North Metro Recreation Commission pursuant to <br /> Minnesota Statute Section 471.59; and <br /> WHEREAS, the North Metro Recreation Commission was developed for the purpose of <br /> providing a recreation program for the involved communities, and <br /> WHEREAS, the delivery of recreation programs and participant involvement have not reached <br /> the original goals of the program; and <br /> WHEREAS, the cities are desirous of looking for a more cost - effective delivery of recreational <br /> services; and <br /> WHEREAS, Article V, Section 1, of the Joint Powers Agreement, provides that the North Metro <br /> Recreation Commission may be terminated any time by a majority vote of the City Councils and <br /> the School District, and <br /> WHEREAS, Article V, Section 3 of the Joint Powers Agreement provides for the division of <br /> assets; <br /> NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Centerville, <br /> Anoka County, Minnesota as follows: <br /> 1. The City Council resolves to terminate the North Metro Recreation Commission <br /> Joint Powers Agreement effective May 31, 1997, <br /> 2. The Cities and the School District mutually agree to return any contributions paid <br /> by any of the four members during calendar year 1997. <br /> 3. The Cities further agree that any balance of funds or assets shall be distributed <br /> pursuant to the provisions of Article V, Section 3 B, of the North Metro <br /> Recreation Joint Powers Agreement. <br />
