RESOLUTION 97 -08 STATE OF MINNESOTA COUNTY OF ANOKA CITY OF CENTERVILLE A RESOLUTION DISSOLVING NORTH METRO RECREATION COMMISSION, WHEREAS, the Cities of Centerville, Circle Pines, Lexington and Independent School District #12, all located in the County of Anoka, State of Minnesota, entered into a Joint Powers Agreement on April 11, 1991, establishing the North Metro Recreation Commission pursuant to Minnesota Statute Section 471.59; and WHEREAS, the North Metro Recreation Commission was developed for the purpose of providing a recreation program for the involved communities, and WHEREAS, the delivery of recreation programs and participant involvement have not reached the original goals of the program; and WHEREAS, the cities are desirous of looking for a more cost - effective delivery of recreational services; and WHEREAS, Article V, Section 1, of the Joint Powers Agreement, provides that the North Metro Recreation Commission may be terminated any time by a majority vote of the City Councils and the School District, and WHEREAS, Article V, Section 3 of the Joint Powers Agreement provides for the division of assets; NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Centerville, Anoka County, Minnesota as follows: 1. The City Council resolves to terminate the North Metro Recreation Commission Joint Powers Agreement effective May 31, 1997, 2. The Cities and the School District mutually agree to return any contributions paid by any of the four members during calendar year 1997. 3. The Cities further agree that any balance of funds or assets shall be distributed pursuant to the provisions of Article V, Section 3 B, of the North Metro Recreation Joint Powers Agreement.
