RESOLUTION 96 -33 <br /> RESOLUTION APPROVING THE VACATION <br /> OF PROPERTY <br /> WHEREAS, the Centerville City Council, on its own Motion, proposed to vacate <br /> approximately 200 by 33 feet of Mill Road laying north of its intersection with Peltier <br /> Circle; described as follows: <br /> EASTERLY OF LOTS 1 AND 2, BLOCK 5, NORTH TO SOUTH, 200 FEET <br /> BY, EAST TO WEST, 33 FEET OF SAID PROPERTY LOCATED IN PELTIER <br /> LAKE HILLS ADDITION. <br /> Except easement rights for public utility and drainage purposes. <br /> WHEREAS, a public hearing with respect to said vacation was set for October 1, 1996 in <br /> accordance with Minnesota Statues; and, <br /> WHEREAS, a Notice of Publication of said hearing was published and posted two weeks <br /> prior to the meeting of October 1, 1996; and, <br /> WHEREAS, the Planning Commission did hold a Public Hearing on October 1, 1996 to <br /> inform any and all interested persons relevant to the vacation of said permanent trailway <br /> easement; and, <br /> WHEREAS, it was determined by the City Council that said permanent trailways as <br /> described above is not needed for trailway purposes; and, <br /> WHEREAS, the Centerville City Council reserves easement rights for utility and drainage <br /> purposes over, under and across said vacated property. <br /> NOW, THEREFORE, BE IT RESOLVED, by the City of Centerville, Anoka County, <br /> Minnesota, that the perpetual easement of Mill Road laying 200 by 33 feet northwest of <br /> intersection with Peltier Circle described below is hereby vacated. <br /> EASTERLY OF LOTS 1 AND 2, BLOCK 5, NORTH TO SOUTH 200 <br /> FEET, EAST TO WEST BY 33 FEET OF SAID PROPERTY LOCATED IN <br /> PELTIER LAKE HILLS ADDITION. <br /> Except easement rights for public utility and drainage purposes. <br /> RESOLUTION, was passed this 9th day of October, 1996. <br />
