DESCRIPTION OF REQUEST:
The side of our backyard faces the street (Peterson Trail). This area of our backyard is
classified as a "front yard ". We request a waiver to the City of Centerville's ordinance
#25.11, #4 regarding fences erected in the front yard shall not exceed four feet in
height. We request a variance to erect our whole backyard fence (including the section
facing Peterson Trail and 73rd Street) to six feet in height. See Diagram on next page.
REASONS FOR REQUEST:
1. PRIVACY: We would like to use our backyard as a retreat. We plan on having a
Victorian Garden with walk ways and setting areas through out the gardens. The six
foot fence will assist in privacy as well as helping to create a quiet meditative retreat.
Our fence would be attractive from the street. It will be a stained, wood fence of
five feet, with the top foot decorated with wooden lattice. It will be well kept, as
will the lawn between the fence and the street.
2. SAFETY FOR CHILDREN IN COMMUNITY: In our Victorian we plan to have a
goldfish pond. The goldfish pond will be eighteen inches to three feet deep. With a
four foot fence, children may be able to climb over it. A six foot fence would be a
better deterrent for the children in the neighborhood.
3. OUR OWN SAFETY: On May 15, 199 , a truck speeding around the corner of
73rd Street & Peterson Trail slid several feet on the wet pavement over the curb,
over our lawn, through our corner fence post, and onto our patio (Police Report
#84861). Had we been sitting in our backyard it is possible that we could have been
injured or killed. Again, a six foot fence would be a better deterrent for any out of
control vehicles.
4. PET CONTROL: We have two Siamese cats (front paws de- clawed). We enjoy
having our pets outdoors with us. A four foot fence would not keep our pets in our
backyard. Again, a six foot fence would.
5. SECURITY: Our home is a small rambler on grade-(no basement area). People
driving by can see into our whole house. Short of keeping the curtains closed day
and night, we are exposed to the public on Peterson Trail. Again, a six foot fence
would give us the privacy we need for better security of our home and its contents.
6. NO OBSTRUCTION: The fence would not be in a location where it would obstruct
a driver's view of an intersection. As you can see by the property diagram on the
next page, the fence is no where near the intersection.
PLEASE PROCESS THIS REQUEST AS SOON AS POSSIBLE. WE ARE
PLANNING AN OPEN HOUSE IN JUNE.
