Ms. Buckbee stated that the park area is a drainage <br /> ditch. <br /> Ms. Buckbee suggested asking RCWD what their easement requirements <br /> are. <br /> Note: Powers- Rasmussen excused herself at 7:30 p.m. <br /> Ms. Buckbee stated that if the ROW is vacated that the city should <br /> still maintain an easement. <br /> Ms. Buckbee mentioned the home in the outlot that may have required <br /> a retaining wall. She stated that the foundation for the home was <br /> to serve as the retaining wall. <br /> MOTION by Wilharber, second by Buckbee to referr this request to <br /> vacate the ROW to P&R and P &Z for comments. Motion carried <br /> unanimously. <br /> Staff is to send letters explaining the action taken. <br /> ADMINISTRATOR REPORTS <br /> Maguire Iron <br /> Mr. March stated he received a call the Maguire Iron after they <br /> received the first installment payment and they had questioned when <br /> the rest would be paid. <br /> Mr. March stated that if the city just wanted to pay for the labor <br /> and not the mileage it would be $1400. Although he did speak with <br /> Greg Hellings and he stated that if the city did not want to pay <br /> any of the remaining portion it would be a viable court case. <br /> Mr. Nyberg had expressed to Mr. March that Maguire Iron does not <br /> want to burn any bridges with the city because of its future needs. <br /> Mr. Wilharber feels that they didn't do the job the first time <br /> therefore costing the city more money in public works staff time, <br /> and no water service to some residents. Therefore he feels it to <br /> be justified in not paying. The other councilmembers agreed. <br /> MOTION by Wilharber, second by Helmbrecht to have Mr. March call <br /> and send a letter to Maguire Iron informing them that the city will <br /> cc6 -5mm 6 <br />
