<br />Section 2. Definitions. <br /> <br />For the purposes of this ordinance, the following terms or words shall be interpreted as <br />follows: <br /> <br />ChDd - Shall mean any person less than 18 years of age. <br /> <br />Chemical dump site - Shall mean any place or area where chemicals or other waste <br />materials used in a clandestine drub lab operation have been located. <br /> <br />City - Shall mean the City of Centerville. <br /> <br />Clandestine drug lab sitesIWasteslSubstances - Shall mean any place or area where <br />law enforcement has determined that conditions associated with the operation of an <br />unlawful clandestine drug lab exist. A clandestine drug lab site may include dwellings, <br />accessory buildings, accessory structures, a chemical dumpsite, any land or personal <br />property which may include vehicle(s), boat(s), trailer(s), etc. Wastes generated from a <br />clandestine drug lab shall be treated, stored, transported or disposed of in a manner <br />consistent with Minnesota Department of Health, Minnesota Pollution Contro~ and <br />Anoka County Health Department rules and regulations. <br /> <br />Clandestine drug lab operation - Shall mean the unlawful manufacture or attempt to <br />manufacture a controlled substance. <br /> <br />Controlled substance - Shall mean any drug, substance or immediate precursor in <br />Minnesota Statute ~ 152.02 Schedules I through V together with any amendments or <br />modifications thereto. The term shall not include distilled spirits, wine, malt beverages, <br />intoxicating liquors or tobacco. <br /> <br />Manufacture, (in places other than a pharmacy) - Shall mean and include the <br />production, cultivation, quality contro~ and standardization, by mechani~ physi~ <br />chemical or pharmaceutical means, and the packing, repacking, tableting, encapsulating, <br />labeling, relabeling, or filling or by other process of drugs. <br /> <br />Owner - Shall mean any person(s), firm(s), corporation(s) or other entity who or which <br />owns, in whole or in part, the land, building, structure, vehicle, boat, trailer or other <br />location associated with a clandestine drug lab site or chemical dump site. <br /> <br />Public Health Nuisance - All dwellings, accessory structures and buildings or adjacent <br />property associated with a clandestine drug lab site are potentially unsafe due to health <br />hazards and are considered a public health nuisance pursuant to Minn. Stat. ~ 463.15, et <br />seq.; ~ 463.15, et seq.; ~ 412.221, et seq.; and 145A01, et seq. <br /> <br />Page 2 of 10 <br />
