<br />Council Member Lee asked whether doing so would create a precedent for the future. <br /> <br />City Attorney Hoeft indicated the precedence would be very limited because this is a <br />specific instance where the $50,000 was to be specifically allocated to better the water <br />system. <br /> <br />Council Member Broussard Vickers indicated that the funds were for the City for <br />improving the water system to the benefit of all residents. She then commented that this <br />would be a departure from the norm of applying the funds to City costs. She further <br />commented that she struggles with whether it is appropriate to benefit 20 odd people <br />versus having that sum being applied to the system that affects all residents with water in <br />the City. <br /> <br />Council Member Capra indicated that she believes that whatever is left over should <br />benefit and offset the costs of those residents because the City did not have to run water <br />that way. <br /> <br />Council Member Broussard Vickers indicated the purpose of extending the water was to <br />loop and that benefits the entire City. <br /> <br />Ms. Paulseth indicated it would be hard to determine whether there is any money left <br />over when figuring in all of the City's costs. <br /> <br />Council Member Lee asked if there would be any further looping that would benefit <br />Lakeland Hills. <br /> <br />Mayor Sweeney indicated that if the documentation indicates the funds were to benefit <br />Lakeland Hills to loop the water system then the funds should be used to offset the City's <br />costs for doing so. <br /> <br />Council Member Broussard Vickers indicated that any looping of the system benefits all <br />residents equally. <br /> <br />Council Member Paar indicated that if the documentation states the funds were to benefit <br />the City to assist with the costs for looping then he does not think it should go to offset <br />assessments to the residents. He further commented that this could set up future Councils <br />for claims to reduce other residents' assessments. <br /> <br />Council Member Capra indicated that she has not had a chance to research the matter and <br />if there were an excess over and above, she would like to use it to offset the costs to the <br />residents. <br /> <br />Mr. Tim Schweppe, 7249 Centerville Road, indicated he has spoken to the developer <br />from Lakeland Hills as well as Mr. Wilharber and the recollection is that the funds were <br />to benefit the residents when water was looped to Lakeland Hills.
