<br />AMENDED AND RESTATED <br />JOINT POWERS POLICE DEPARTMENT CONTRACT (;lTlliS OF CENTERVILLE, <br />CIRCLE PINES AND LEXINGTON MINNESOTA <br /> <br />This contract is entered into this 1st day of January 2004, by and between the City of <br />Centerville, hereinafter referred to as "Centerville," and the City of Circle Pines, hereinafter <br />referred to as "Circle Pines," and the City of Lexington hereinafter referred to as "Lexington", all <br />municipal corporations located in the State of Minnesota, County of Anoka, sometimes <br />hereinafter referred to collectively as ''member cities". <br /> <br />WHEREAS, Centerville, Circle Pines and Lexington desire to establish, equip and <br />operate a joint powers police department to protect, safeguard and furnish police protection for <br />their citizens pursuant to Minnesota Statutes Section 436.06, and <br /> <br />WHEREAS, the parties hereto desire to establish a Board of Police Commissioners <br />pursuant to the authority of Minnesota Statutes Section 436.06, SOOd. 2, hereinafter referred to as <br />the "Governing Board" to control and supervise the administration of the joint police department. <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED as follows: <br /> <br />SECTION I <br />GENERAL PURPOSE <br /> <br />The purpose of this agreement is to maintain an organization to jointly and cooperatively provide <br />community policing that focuses on crime and disorder through the delivery of police services <br />that includes aspects of traditional law enforcement, as well as prevention, problem solving, <br />COIDli1unity engagement and partnerships. The area to be serviced is the corporate limits of the <br />member cities. <br /> <br />SECTION n <br />DEFINITIONS <br /> <br />2.1 Dq>artment: Department is the police department created by this agreement for the purpose <br />of providing police protection services. <br /> <br />2.2 Financial Accounting: Financial accounting includes preparation of reports, bill lists and <br />audits for the purpose of providing a depiction of the financial status of the department. <br /> <br />2.3 Financial Default: Financial default occurs when any member is more than 90 days <br />overdue for its monthly payment to the department. <br /> <br />2.4 Non-Budgeted Expenditures: Non-budgeted expenditures are expenditures not listed in <br />the agreed upon budget and/or expenditures in excess of the agreed upon budget. <br /> <br />2.5 Rules and Regulations: Rules and regulations are the policies and procedures adopted by <br />the Goveming Board governing the action of the Governing Board and its employees. <br /> <br />- 1 - <br />
