<br />b) The increase in the most restrictive levy limit applicable to the budget year placed on <br />any of the member cities over the levy limit for that member municipality for the prior <br />year. <br /> <br />In the event (a) or (b) decreases, the operating budget shall remain the same. <br /> <br />SECTION X <br />DISPUTE <br />RESOLUTION <br /> <br />lO.1 Dispute Process. Whenever there is a disagreement between the member cities as to the <br />meaning or application of any of the terms hereunder, or as to the respective rights, powers, <br />duties and obligations of the member cities, and the disagreement cannot be resolved, the parties <br />shall engage in a dispute resolution process as follows: <br /> <br />a) A member city initiating the dispute resolution process shall forward a written <br />statement of the dispute to a regular or special meeting of the Governing Board. The <br />Governing Board shall have six (6) months to resolve the dispute. <br /> <br />b) If the dispute is not resolved as provided for in Section 10(a), the matter shall be <br />forwarded to the Anoka County Mediation Service or if Anoka County Mediation <br />Service is unavailable, such other mediation service as determined by the Governing <br />Board. The mediation service shall have ninety (90) days to resolve the dispute. <br /> <br />c) If the dispute is not resolved as provided for in Section lO(a) and 10(b), then upon a <br />majority vote of the member cities, the dispute shall proceed to arbitration as provided <br />for in Section X of this Agreement. <br /> <br />SECTION XI <br />ARBITRATION <br /> <br />11.1 Arbitration Procedures. <br /> <br />a) Arbitration shall be conducted by and under the commercial arbitration rules of the <br />American Arbitration Association, and shall be conducted by a single arbitrator. <br /> <br />b) Within thirty (30) days after the appointment of the arbitrator and no sooner than ten <br />(10) days following written notice to the member cities, the arbitrator shall commence a <br />hearing on the dispute. <br /> <br />c) The hearings shall be open to the public, recorded and may be transcribed at the request <br />and expense of any member city. <br /> <br />- 8 - <br />
