Developers Agreement <br /> <br /> <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />DATE: <br /> <br />October 22, 2003 <br /> <br />I forwarded the developers agreement that is in your council packet to both the City <br />Engineer and the City Attorney for their review. I also forwarded the agreement to Mr. <br />Paul Keller, Sedona Homes. <br /> <br />Upon review, the City Engineer provided the hand written notations attached to this <br />memo and as follows: <br /> <br />The inclusion of language regarding private improvements such as utilities and the <br />corresponding dollar amount of $90,000.00. Mr. Peterson also included $41,500.00 for <br />landscaping and $4,500.00 for sodding of the common areas within the development. <br />Wtth these recommendations, the developer's retainage would be adjusted accordingly. <br /> <br />Upon receiving the attached facsimile copy of the developer's agreement from Mr. <br />Keller with his suggested modifications, I forwarded a copy of the same. to Mr. Hoeft for <br />his review. <br /> <br />Staff along with Mr. Hoeft have the following concerns: <br /> <br />. Sedona Homes would need to provide the City with documentation <br />regarding Jackson Commercial's financial backing and orvni7.ationally <br />documentation. <br />. The City would need to review all purchase documentation regarding this <br />agreement/contract. <br />. It appears that Sedana Homes/Jackson Commercial, LLC. desires to phase <br />the project. Individual development contracts would correspond with the <br />phases. <br />. Include language addressing the need of the developer to fu1fi11 all laws <br />regarding ADA requirements. Parking ramps, space, signage, etc. prior to <br />issuance of Occupancy Permits. <br />. Sedona Homes/Jackson Commercial, LLC. has requested that the City <br />allow for a one year guarantee/warranty regarding installation and <br />construction of private utilities. This in turn would only allow a one year <br />letter of credit. The City's previous policy has been two years for both of <br />
