", .J J:.l1.t(j ~ ~ J <br /> <br />TO: Honorable Mayor and Council Members <br />FROM: Teresa Bender, City Clerk~l, <br />SUBmCT: 7016 & 7020 Brian Court (Property Line Dispute/Shed) <br />DATE: October 3, 2003 <br /> <br />Upon discussing :Mr. Carlson/Ms. Jarosz complaint regarding the placement of an <br />accessory structure with the Building Inspector Mr. Cook, Mr. Cook has stated that the <br />accessory structure was constructed shortly following the construction of the residence in <br />1991 and that its approximate size is 8' x 10. <br /> <br />You will find attachments that are a part of the Ordinance #4 that regulates accessory <br />structures/tooVstorage sheds that was in effect at that time. It appears that there was an <br />addition to the ordinance in 1991 that stated that storage sheds (up to 200 sq. ft.) shall be <br />allowed to be constructed within 10' of a rear setback requirement, except in easement <br />areas, in residentially zoned districts. <br /> <br />You will also find attachments of Mr. Carlson's site survey and a plat map of the <br />subdivision. It does appear that there is a 30' or more easement in the rear ,of 7016 Brian <br />Court and this is where the accessory structuresltooVstorage shed is located. <br /> <br />The City placed a correction notice at the residence of7016 Brian Court on July 16,2003 <br />and requested that they contact staff within 10 days. Staff has made numerous attempts <br />to discuss this matter with one of the residents at the address. <br /> <br />Council may desire to direct staff to forward a letter via U.S. Postal Service (Certified <br />Mail) requesting the sheds relocation within 30 days. If the owners do not become <br />compliant within that timeframe, a Centennial Lakes Police Officer can cite them for <br />non-compliance of Ordinance 4 (Violation). Mr. Hoeft would then have to determine <br />whether to bring this case before a judge. <br />
