Motion carried <br />unanimouslv. <br /> <br />V. A W ARDSIPRESENTATIONS/APPEARANCES <br /> <br />None. <br /> <br />VI. PUBLIC HEARING(S) <br /> <br />1. Ordinance #49 - Noise <br /> <br />Mayor Sweeney opened the public hearing at 6:40 p.m. <br /> <br />Ms. Moore-Sykes indicated that Staff had provided information on the decibel readings <br />around town as requested; <br /> <br />Council Member Broussard Vickers asked City Attorney Hoeft where to start based on <br />the averages provided by Staff. <br /> <br />City Attorney Hoeft indicated that in order to prosecute noise violations the violation <br />level has to be higher than the ambient noise level. He then indicated Council would <br />need to discuss the ambient noise level and make a determination as to what decibel level <br />over that would be a violation of the noise ordinance. <br /> <br />Council Member Lee indicated he would like to take readings to have a better idea of <br />"f' what types of noises register what reading on the meter. <br /> <br />Mayor Sweeney indicated that the ambient noise inside of Kelly's was recorded at 74. <br /> <br />Mr. Palzer indicated that pointing the meter across the street from Kelly's still registered <br />a 74. <br /> <br />Mayor Sweeney commented that the average noise outside during the afternoon is 68. <br /> <br />Page 2 of 11 <br />
