<br />August 13,2003 <br /> <br />TO: The Honorable Mayor and City Council Member~ <br />City of Centerville <br /> <br />Request modification of Development Contract Hunters Crossing 2nd Addition from _ <br />Richard S. Carlson Development,.LLC, a Minnesota limited liability company (the <br />Developer) and the City of Centerville, a municipaf~corporation organized under the laws <br />of the State of Minnesota (the City). <br /> <br />A. Page 5. C. Street and Utility Improvements. <br />Paragraph 3. <br /> <br />Prior to the preparation of final plans and specifications for <br />the construction of said improvements, the Developer shall <br />provide to the City a cash escrow in the amount of <br />$12,500.00 to provide for financing the cost of preparing the <br />Development Contract and said final plans and specifications <br />by the City Engineer. Furthennore, the Developer shall also <br />provide a cash escrow to the City in an amount indicated in <br />writing to provide for financing the cost of inspection, <br />staking, and construction administration by the City Engineer. <br /> <br />ADD: <br /> <br />The rmal determination of utility cost by the City <br />Engineer will include the reconciliation of the above <br />escrows and this amount will be subtracted from the 30% <br />indirect costs as per the feasibility study. <br /> <br />B. 6. G. Occupation of premises. <br /> <br />OCCUPATION OF PREMISES. The Developer further <br />agrees that it will not cause to be occupied any. premises upon <br />the plat or any property within the plat until the completion of <br />the gas,. electric, telephone, cable television, water, and sewer <br />improvements required by this Development Contract have <br />been installed, unless the City has agreed in writing to waive <br />this requirement as to a specific premises. Furthermore, <br />Developer shall be granted no certificates of occupancy for <br />homes within the plat prior to substantial completion of all <br />Private and Street and Utility Improvements described in this <br />Contract, and as detailed in paragraph B.2(b).
