<br />" <br /> <br />" > <br /> <br /> <br />TO: <br /> <br />Honorable Mayor and Council Members <br />Kim Moore-Sykes, City Administrator & Teresa Bender, City Clerk\CVp. . <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Requests for 2:00 am Bar Closing <br /> <br />DATE: <br /> <br />July 3, 2003 <br /> <br />As the result of recent legislative action, the State is now allowing those establishments <br />that have on-sale licenses to continue serving alcoholic beverages until 2:00 am, <br />provided applicants have received formal approval from the local municipality. Also, as <br />I have reported in recent Week in Reviews, the City Attorney has determined that the <br />City's ordinance allows on-sale establishments to remain open once approval has been <br />received from the City. <br /> <br />Attached are copies of the applications for Trio Inn, Kelly's Komer and Waterworks <br />Beach Club. Please note that Mr. Bisek has an outstanding fine for a recent compliance <br />check failure. <br /> <br />Council may also consider placing a fee for allowing such a request in the City's fee <br />schedule to recoup associated costs. Teresa has spoken with Chief Heclcman regarding <br />the 2:00 am closing and how it would affect the Police Department and possible <br />additional expenditures. Chief Heckman stated that a standard Dill takes an officer <br />approximately two (2) to three (3) hours to process from beainning to end. Chief <br />Heckman was reluctant to predict how the 2:00 a.m. cloc!ling would effect such things as <br />additional staff: etc. without clear and precise experience in liquor establishments <br />remaining open until 2:00 am Chief Heckman stated that the Police Department is <br />willing to provide services as requested by Council. Chief Heckman also stated that he <br />felt that primarily this legislation was enacted for more metropolitan communities such as <br />St. Paul or Minneapolis. <br /> <br />As a side note: Teresa spoke with Mr. Vanderbeek, Wise Guys Pizza today. Mr. <br />Vanderbeek reported that he did not desire to submit the 2:00 a.m closing application. <br />
