however all dogs over the age of six months shall have an identification tag affixed to a collar which indicates the <br /> owner name, address and a contact phone number. <br /> C. Licensing Pet Shops & Kennels. Pet shops and kennels shall require a license from the City. It is unlawful to <br /> operate a kennel in any residentially zoned district. Pet Shops and kennels are permitted in certain zoning district <br /> but require a conditional use permit. <br /> D. License validity; fees. Licenses shall be issued as follows: <br /> 1. All fees will be established from time to time by ordinance or resolution of the city council. Licenses <br /> may be issued at any time during a license period, provided that the fees set forth in this section shall be prorated <br /> on the basis of the number of months remaining in any such period.However the, minimum fee shall be no less <br /> than the licensing fee for a six month period. For this purpose fifteen days or more shall be construed a full <br /> month. Application for license shall be filed on the appropriate forms provided by the city. <br /> 2. Kennel licenses. No kennel license may be issued or renewed unless the applicant has a valid <br /> conditional use permit for the facility. <br /> 3. The commencement and ending period of licenses shall be set out in the ordinance or resolution that <br /> establishes fees for such license. Licenses shall be valid for a period of two years. <br /> E. Unlawful acts. <br /> 1. It is unlawful for any animal to defecate on public property or the private property of another, without <br /> the owner or person in control of the animal immediately removing the excrement and disposing of it in a sanitary <br /> manner. <br /> 2. It is unlawful for any animal to be in or upon any city park, street, sidewalk or trail property unless <br /> the owner or person in control of the animal restrains it by a leash or the animal is housed in a portable crate or <br /> kennel, and unless the owner or person in control of the animal has a bag or other receptacle for the collection and <br /> proper disposal of the animal's excrement in their possession. <br /> 3. It is unlawful for any animal to be at large. An owner or person in control of the animal is responsible <br /> under this chapter for any animal that is at large. <br /> 4. It is unlawful to possess more than three dogs, three cats, or three of any other type of animal or in <br /> combination a maximum of four animals over the age of six months to be kept on any property in the city, except <br /> in a location where a licensed pet shop or kennel is allowed or other exceptions as specifically set forth in this <br /> chapter. <br /> 5. It shall be unlawful for any animal to habitually or frequently bark or cry; to frequent school grounds; <br /> to chase vehicles; to molest or disturb any person if such person is not on the property of the owner or custodian <br /> of such animal; or to molest, defile or destroy any property, public or private. It shall be the obligation and <br /> responsibility of the owner or custodian of any animal in the city to prevent such animal from committing any act <br /> which constitutes a nuisance. <br /> 6. It is unlawful for the owner or person in control of the animal to permit such unsanitary conditions on a <br /> premises that the maintenance or keeping of the animal creates a danger to the public health, safety, or welfare or <br /> odors are an annoyance to the public in the vicinity. Failure on the part of the owner or custodian to prevent their <br /> animal from committing an act of nuisance shall be a violation of this section. <br /> Exceptions.
