<br />OFFENSES-NUSCELLANEOUS <br /> <br />S 389.100 <br /> <br />~ <br /> <br />verizing of razed building or structural materials <br />performed in an open area by use of portable <br />crushing m~chinery. <br /> <br />The purpose of the ordinance is to reduce the <br />impacts and costs associated with the demolition <br />of primarily commercial and industrial structures <br />while protecting the public health, safety and <br />welfare by addressing concerns relating to the <br />transitory effect of noise, dust, stormwater run-off <br />and related environmental impacts resulting from <br />temporary crushing activities. <br /> <br />(b) Requirements. Temporary crushing activi- <br />ties must comply with the following: <br /> <br />1. The performance standards in sections <br />542.490 to 542.540 of the zoning code; <br />chapters 46, 47, 48, 117 and 389 of the <br />code of ordinances; and state rules and <br />statutes as determined applicable by the <br />director of inspections when issuing the <br />wrecking permit required by section 117.10 <br />of this code. <br /> <br />2. Materials crushed, ground or pulverized <br />on-site shall originate only from demoli- <br />tion activities conducted on the site and <br />shall not include any materials conveyed <br />to the site from a different location. <br /> <br />3. Temporary crushing activities shall not <br />exceed one hundred twenty (120) consec- <br />utive calendar days from the date of issu- <br />ance of a required permit. <br /> <br />4. A temporary sign, three (3) feet by four (4) <br />feet, indicating the name, address and <br />phone number{s) of the person(s) or agent(s) <br />of the company conducting the temporary <br />on-site crushing activities shall be placed <br />within ten (10) feet of all public rights-of- <br />way adjacent to the project site. The com- <br />pany conducting the temporary crushing <br />activities shall ensure that an agent re- <br />sponsible for the activities conducted on- <br />site is available on-site or by phone on a <br />twenty-four (24) hour basis. Prohibited acts. (a) The following <br />acts are not allowed in the city and the causing <br />thereof are prohibited: <br /> <br />(1) Intentionally sounding or permitting the <br />sounding outdoors of any fire, burglar, or <br />civil defense alarm, siren, whistle, or sim- <br />ilar stationary emergency signaling de- <br />vice except in the following circumstances: <br /> <br />a. Existence of an emergency. <br /> <br />b. Testing the device, not to exceed four <br />(4) minutes in an hourly period, un- <br />less approved by the director when <br />there is no reasonable alternative to <br />exceeding four (4) minutes oftesting <br />and the testing is required by state <br />or federal laws, rules or regulations. <br /> <br />c. The sounding of a properly main- <br />tained car alarm subject to para- <br />graph 6 of this section. <br /> <br />(2) Loading, unloading, opening, closing or <br />other handling of boxes, crates, bottles, <br />containers, building and construction ma- <br />terials and equipment, demolition debris, <br />garbage cans, garbage dumpsters or carts, <br />scrap metal or other metal waste or sim- <br />ilar objects outside of an insulated build- <br />ing in a residentially used area between <br />the hours of 10:00 p.m. and 6:00 a.m. This <br />shall not prohibit the reasonable and care- <br />ful handling of garbage carts and <br />recyclables by residents setting them out <br />for solid waste or recycling collection if <br />the immediately following day is a collec- <br />tion day. <br /> <br />(3) No person shall load or unload a solid <br />waste compacting vehicle, solid waste pro- <br />cessing vehicle, solid waste collection ve- <br />hicle, or recycling collection vehicle out- <br />side of an insulated building in any <br />residentially used area between the hours <br />of 10:00 p.m. and 6:00 a.m. <br /> <br />(4) No person shall operate a parking lot <br />sweeper or commercial snow plowing equip- <br />ment in any residentially zoned and used <br />area between the hours of 10:00 p.m. and <br />6:00 a.m. Snow plowing of off-street park- <br />ing areas and adjoining walkways with <br />
