OFFENSES-NUSCELLANEOUS S 389.100 ~ verizing of razed building or structural materials performed in an open area by use of portable crushing m~chinery. The purpose of the ordinance is to reduce the impacts and costs associated with the demolition of primarily commercial and industrial structures while protecting the public health, safety and welfare by addressing concerns relating to the transitory effect of noise, dust, stormwater run-off and related environmental impacts resulting from temporary crushing activities. (b) Requirements. Temporary crushing activi- ties must comply with the following: 1. The performance standards in sections 542.490 to 542.540 of the zoning code; chapters 46, 47, 48, 117 and 389 of the code of ordinances; and state rules and statutes as determined applicable by the director of inspections when issuing the wrecking permit required by section 117.10 of this code. 2. Materials crushed, ground or pulverized on-site shall originate only from demoli- tion activities conducted on the site and shall not include any materials conveyed to the site from a different location. 3. Temporary crushing activities shall not exceed one hundred twenty (120) consec- utive calendar days from the date of issu- ance of a required permit. 4. A temporary sign, three (3) feet by four (4) feet, indicating the name, address and phone number{s) of the person(s) or agent(s) of the company conducting the temporary on-site crushing activities shall be placed within ten (10) feet of all public rights-of- way adjacent to the project site. The com- pany conducting the temporary crushing activities shall ensure that an agent re- sponsible for the activities conducted on- site is available on-site or by phone on a twenty-four (24) hour basis. (a) The following acts are not allowed in the city and the causing thereof are prohibited: (1) Intentionally sounding or permitting the sounding outdoors of any fire, burglar, or civil defense alarm, siren, whistle, or sim- ilar stationary emergency signaling de- vice except in the following circumstances: a. Existence of an emergency. b. Testing the device, not to exceed four (4) minutes in an hourly period, un- less approved by the director when there is no reasonable alternative to exceeding four (4) minutes oftesting and the testing is required by state or federal laws, rules or regulations. c. The sounding of a properly main- tained car alarm subject to para- graph 6 of this section. (2) Loading, unloading, opening, closing or other handling of boxes, crates, bottles, containers, building and construction ma- terials and equipment, demolition debris, garbage cans, garbage dumpsters or carts, scrap metal or other metal waste or sim- ilar objects outside of an insulated build- ing in a residentially used area between the hours of 10:00 p.m. and 6:00 a.m. This shall not prohibit the reasonable and care- ful handling of garbage carts and recyclables by residents setting them out for solid waste or recycling collection if the immediately following day is a collec- tion day. (3) No person shall load or unload a solid waste compacting vehicle, solid waste pro- cessing vehicle, solid waste collection ve- hicle, or recycling collection vehicle out- side of an insulated building in any residentially used area between the hours of 10:00 p.m. and 6:00 a.m. (4) No person shall operate a parking lot sweeper or commercial snow plowing equip- ment in any residentially zoned and used area between the hours of 10:00 p.m. and 6:00 a.m. Snow plowing of off-street park- ing areas and adjoining walkways with
