Persons responsible for <br /> <br />such work shall inform the [police department, <br /> <br />building inspector, or other specified officer or <br /> <br />agency] of the need to initiate such work or, if the <br /> <br />work is commenced during nonbusiness hours of <br /> <br />the city, at the beginning of business hours of the <br /> <br />first business day thereafter. <br /> <br />Any person <br /> <br />responsible for such emergency work shall take all <br /> <br />reasonable actions to minimize the amount of noise <br /> <br />Section 7. Power and Duties of [police <br /> <br />department, building inspector, or other specified <br /> <br />oLTzcer or agency]. <br /> <br />Subdivision 1. <br /> <br />Administering officer. The noise control program <br /> <br />established by this ordinance shall be administered <br /> <br />by the [police department, building inspector, or <br /> <br />other specified officer or agency], who shall be <br /> <br />appointed by the (council or other appointing <br /> <br />authority). <br /> <br />Comment: In most cities the noise control <br />duties are assigned to an existing officer or <br />department. In that case the language <br />should be altered by substituting the name <br />of the official or department and omitting <br />the clause about the appointment. lnstead <br /> <br />of substituting the name of that official or <br />department throughout the ordinance, the <br />subdivision may be modified to read, "The <br />noise control program established by this <br />ordinance shall be administered by the <br />noise control officer. Until otherwise <br />provided by ordinance, the [police <br />department, building inspecto~ or other <br />specified oLTzcer or agency] shall serve as <br />the noise control officer. JI <br /> <br />If the council provides for a separate <br />position of noise control oLTzcer, the <br />appointing authority referred to in this <br />subdivision is the general appointing <br />authority established by law or charter, <br />such as the manager in a council _ <br />manager city, the mayor in a strong mayor <br />- council city, or the council in most <br />statutory and some charter cities. If a new <br />position is established and the city has a <br />formal merit system, an additional <br />provision placing the position in the <br />classified service may be required if new <br />positions are not automatically in that <br />class in the absence of appropriate action <br />to be contrary. <br /> <br />Subd. 2. Testing procedures. The [police <br /> <br />department, building inspector, or other specified <br /> <br />oLTzcer or agency] shall adopt guidelines <br /> <br />establishing <br /> <br />the <br /> <br />test <br /> <br />procedures <br /> <br />and <br /> <br />11,1 <br /> <br />instrumentation to be used in enforcing the <br /> <br />provisions of Section 4 imposing noise standards. <br /> <br />A copy of such guidelines shall be kept on file in <br /> <br />the office of the [police department, building <br /> <br />inspector, or other specified officer or agency] at <br /> <br />9 <br />
