<br />Section 3. Enforcement. Subdivision 1. <br /> <br />Enforcement duties. The [police department, <br /> <br />building inspector, or other specified officer or <br /> <br />agency] shall enforce the provisions of this <br /> <br />ordinance. The [substitute other specified officer <br /> <br />or agency if listed above] may inspect private <br /> <br />premises other than private residences and shall <br /> <br />make all reasonable efforts to prevent violations of <br /> <br />this ordinance. <br /> <br />Comment: This subdivision must be adapted to <br />fit the administrative structure and <br />personnel of the individual city. In many <br />small cities the police department may be <br />the only agency available for the purpose. <br />In that case the subdivision is consistent <br />with the general responsibility given the <br />police department to enforce laws and <br />ordinances. <br /> <br />Subd. 2. Civil remedies. This ordinance may <br /> <br />be enforced by injunction, action for abatement, or <br /> <br />other appropriate civil remedy. <br /> <br />Comment: Although it may not be possible to <br />affect the jurisdiction and procedure of the <br />courts by ordinance provision in most <br />cities, the provision at least calls attention <br />to available civil remedies. <br /> <br />Subd. 3. Noise impact statements. The <br /> <br />council may require any person applying for a <br /> <br />change in zoning classification or a permit or <br /> <br />license for any structure, operation, process, <br /> <br />installation or alteration, or project that may be <br /> <br />considered a potential noise source to submit a <br /> <br />noise impact statement on a form prescribed by the <br /> <br />council. It shall evaluate each such statement and <br /> <br />take its evaluation into account in approving or <br /> <br />disapproving the license or permit applied for or <br /> <br />the zoning change requested. <br /> <br />Comment: If there is some other officer who <br />may appropriately require noise impact <br />statements, that officer may be substituted <br />for the council in the first sentence and the <br />second then may be altered to provide for <br />evaluation of the statement by that officer <br />and the making of appropriate <br />recommendations to the council or other <br />officer authorized to take action. Some <br />cities, particularly smaller cities, may <br />prefer to omit this subdivision altogether. <br /> <br />Subd.4. Criminal penalties. Any violation <br /> <br />of this ordinance involving the operation of a <br /> <br />motor vehicle is a petty misdemeanor and, upon <br /> <br />conviction, the violator shall be punished by a fine <br /> <br />I' <br />I' <br /> <br />not to exceed $100. Every person who violates any <br /> <br />other provision of this ordinance is guilty of a <br /> <br />misdemeanor and shall, upon conviction, be <br /> <br />subject to a fine of not more than $700 or <br /> <br />imprisonment for a term not to exceed 90 days, or <br /> <br />19 <br />
