MEMORANDUM <br /> To: Mayor and City Council <br /> From: Kurt B. Glaser, City Attorney <br /> Date: January 19, 2012 <br /> RE: Joint Powers Agreements to participate in a web -based system for charging criminal <br /> defendants. <br /> Summary: <br /> I recommend approval of Resolution XX -XX, which is the Joint Powers Agreement related to <br /> the implementation of eCharging within the City Attorney's Office and the Centennial Lakes <br /> Police Department. <br /> Discussion: <br /> The Bureau of Criminal Apprehension (BCA) created an eCharging system allowing prosecution <br /> and law enforcement agencies to submit criminal complaints to the court via electronic means. <br /> The system is designed to reduce the cost to transport documents between agencies and reduce <br /> the amount of time officers must spend transporting documents to court. <br /> This system will result in an overall cost savings to the City. The Centennial Lakes Police <br /> Department will no longer have to dedicate personnel to transport time - sensitive documents to <br /> court. Likewise, this will eliminate the need to pay private courier companies to transport time - <br /> sensitive legal documents from my office to court. The only downside will be a slight increase in <br /> labor for data entry. <br /> There are two contracts which must be signed. The first document (State of Minnesota Joint <br /> Powers Agreement Criminal Justice Agency) is the Joint Powers Agreements between the BCA <br /> and the City which authorizes your prosecutor to participate in the eCharging system. The <br /> second document (Court Data Services Subscriber Amendment To CJDN Subscriber Agreement) <br /> is a contract between the State Courts and the City which authorizes your prosecutor to <br /> participate in the eCharging system. <br /> Two notes of interest: <br /> You will notice that the top of this contract indicates the agreement is between the State of <br /> Minnesota and both Centerville and Lexington. We are continuing a conversation with the BCA <br /> about whether or not both cities should be named in a single contract. <br /> You will also notice that these agreements allow the State to charge a fee for participation in this <br /> program. At this time there is no fee being charged. <br /> 24 <br />
