CONTRACT NO. <br /> SP 02 - 090 - 01 2010 - 0601 <br /> CONTRACTOR NAME ADDRESS CITY STATE ZIP <br /> Veit, Inc. 14000 Veit Place Rogers MN 55374 - 9583 <br /> LOCATION OF WORK: TOTAL SUPPLEMENTAL AGREEMENT AMOUNT <br /> Centerville, MN $1,085.28 <br /> This Contract is between the Local Government Entity and Contractor as follows: <br /> WHEREAS: This Contract provides for, among other things, construction of twelve (12) <br /> bituminous trail and concrete sidewalk throughout the City of Centerville; and <br /> WHEREAS: Construction operations were suspended during the period of July 1 to July 21, <br /> 2011 due to State Govemment shutdown; and <br /> WHEREAS: The Contractor has filed a request for adjustment in accordance with 1402.26 <br /> relating to actual cost incurred as a result of the State Government shutdown; <br /> and <br /> WHEREAS: Specifically the Contractor's request for adjustment includes, but is not limited to <br /> the following categories: <br /> • home office overhead <br /> • extended field overhead <br /> • idle equipment <br /> • unanticipated mobilization costs <br /> • erosion control maintenance <br /> ;and <br /> WHEREAS: The State's Engineer has reviewed the Contractor's request for adjustment in <br /> accordance with 1402.26 and determined that an adjustment to the Contract is <br /> warranted <br /> NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AND UNDERSTOOD THAT: <br /> 1. The Contractor certifies that It has not knowingly made a false claim or used a false <br /> record or statement in connection with this Supplemental Agreement. The Contractor <br /> acknowledges this claim /adjustment is subject to Mn Statutes Chapter 15C (False <br /> Claims Against the State). <br /> 2. The Contractor certifies the request for adjustment in accordance with 1402.26 does not <br /> include any profit. <br /> 3. The State offers and the Contractor accepts compensation in accordance with the <br /> estimate of cost shown below. <br /> a. The Contractor will be compensated for twenty -one (21) additional days of Traffic <br /> Control at the State's pre - established unit prices for Additional Traffic Control <br /> Devices. Because the additional time is over 90 days, payment per Unit Day will <br /> continue at a reduced price of 40% of the Unit Price. <br /> 7 ? <br />
