All in favor. Motion carried unanimously. <br /> <br /> <br />VI.AWARDS/PRESENTATIONS/APPEARANCES <br /> <br /> <br />1.S & B Center Corporation, Ms. Victoria Byrne & Mr. Jeff Schultz, Kelly’s <br />Korner Liquor Violation <br /> <br />Administrator Larson stated that an alleged liquor violation had taken place at Kelly’s <br />Korner and that Staff provided the licensee of the notice of this evenings meeting and <br />representatives of the licensee are present. <br /> <br />Attorney Glaser reviewed the process for providing a hearing for licensees when an <br />alleged violation has occurred and stated that Council is performing similarly to a judge <br />who is hearing a case and Attorney Glaser is acting as an advocate to the City. Attorney <br />Glaser reviewed the City Code with requirements for holding a liquor license, <br />presumptive penalties, and Council’s need to determine whether a violation of license <br />conditions had occurred. Attorney Glaser presented the Council with the facts of the case <br />and stated that the bartender had subsequently appeared in court and admitted to a <br />violation of the law regarding the presence of alcoholic beverages on the premises after <br />the permitted time.. Attorney Glaser stated that the bartender served alcohol at 1:50 a.m. <br />to several individuals, at 2:32 a.m. one of these individuals was spotted by the police <br />department in the parking lot of Kelly’s with a bottle of beer. Attorney Glaser stated that <br />only the licensee or employees of the licensee can be on the premises a half hour after <br />Page 3 of 7 <br /> <br />
