Findings and Decision Related to Chapter 156.006 & 156.016- 156.052 <br /> October 2, 2012 <br /> Findings and Decision Related to Chapter 156.006 & 156.016- 156.052 <br /> The Planning & Zoning Commission met on September 4, 2012 and again on <br /> October 2, 2012, to consider amending the city Code Chapter 156. <br /> Findings: <br /> 1) The City Code, Chapter 156 regulates land use and zoning matters. <br /> 2) The Commission held a public hearing on September 2, 2012, to consider <br /> amendments to Chapter 156 that would clarify the allowed uses and restate the <br /> allowed uses in the various zoning districts in a chart format. The Commission <br /> considered public comment in making these findings and its decision. <br /> 3) The Commission finds that the chart format, identified as Table 156 -A.1 will be <br /> easier to use than the previous method of stating the uses within the text of the <br /> Code. <br /> 4) The Commission determined that it should clarify various group residential uses <br /> and day care. <br /> 5) The Commission finds that "Residential Care For Juvenile Sex Offenders" is a use <br /> appropriate for the R -3 district, but determines that in order to protect the safety of <br /> children and other vulnerable persons, this use should be located away from places <br /> that children and other vulnerable persons frequently are present. The Commission <br /> determined that an appropriate distance would be 1500 feet from any bike path or <br /> trail, bus stop, school, day care, nursing home, residential facility serving children <br /> or vulnerable persons, public park, recreational use facility, or other public or <br /> private place where children or vulnerable persons would normally frequent or <br /> congregate. <br /> DECISION: <br /> The Planning and Zoning Commission recommends that the City Council adopt the <br /> attached Ordinance amending Chapter 156, including Table 156 -A.1. <br /> Approved by the Planning & Zoning Commission of the City of Centerville on <br /> October 2, 2012 <br />
