Anoka County Contract No. 2012 -0340 <br /> JOINT POWERS AGREEMENT <br /> RELATING TO THE AMENDMENT OF THE <br /> RICE CREEK CHAIN OF LAKES PARK RESERVE BOUNDARY <br /> This Agreement is made and entered into this day of , 2012, by and <br /> between the County of Anoka, a political subdivision of the State of Minnesota, 2100 Third <br /> Avenue North, Anoka, Minnesota 55303 ( "County "), and the City of Centerville, a municipal <br /> corporation under the laws of the State of Minnesota, 1880 Main St., Centerville, Minnesota <br /> 55038 ( "City "). <br /> WITNESSETH <br /> WHEREAS, the County desires to expand the boundaries of the Rice Creek Chain of <br /> Lakes Park Reserve to include an approximately 1.3 acre parcel depicted in the attached Exhibit <br /> A ( "Leibel Property "); and <br /> WHEREAS, the County desires to acquire the Leibel Property for use as a parks <br /> maintenance facility and the interpretation of a historic Native American burial mound; and <br /> WHEREAS, the City's concurrence is required prior to the County's submission of a <br /> master plan amendment to the Metropolitan Council to include the Leibel Property in the Rice <br /> Creek Chain of Lakes Park Reserve boundary; and <br /> WHEREAS, the City has expressed concern about the loss of the tax base as a result of <br /> the County's pending acquisition of the Leibel Property; and <br /> WHEREAS, subject to the terms and conditions contained herein, the County has <br /> agreed to provide specified considerations to the City as a result of the County's acquisition of <br /> the Leibel Property; and <br /> WHEREAS, Minnesota Statute, Section 471.59 authorizes political subdivisions of the <br /> state to enter into joint powers agreements for the joint exercise of powers common to each. <br /> NOW, THEREFORE, IT IS MUTUALLY STIPULATED AND AGREED AS FOLLOWS: <br /> I. PURPOSE <br /> The parties have joined together for the purpose of approving the change in the Rice <br /> Creek Chain of Lakes Park Reserve Boundary and describing the specified <br /> considerations to be provided by the County to the City as a result of the County's <br /> purchase of Leibel Property. <br /> II. METHOD <br />
