City's Responsibilities: <br /> A. The City may construct and maintain a "Welcome to Centerville" sign within the license <br /> area on the southeast corner of the Leibel Property, upon review and approval of the <br /> design by the Anoka County Parks and Recreation Department. <br /> B. By approving and entering into this joint powers agreement the City concurs and agrees <br /> that the boundary of the Rice Creek Chain of Lakes Park Reserve shall be amended to <br /> include the Leibel Property. <br /> Contingencies: <br /> The County and City agree that if the County is unable to obtain approval of a master plan <br /> amendment from the Metropolitan Council; an Acquisition Opportunity Grant from the <br /> Metropolitan Council and /or close on the purchase of the Leibel Property as provided in this <br /> paragraph, then this agreement shall be null and void. <br /> III. TERM <br /> This Agreement shall continue until terminated by mutual agreement of the parties. <br /> IV. CONTRACTS AND PURCHASES <br /> All contracts let and purchases made pursuant to this Agreement shall be made by the <br /> City and /or County shall be in conformance to the State laws. <br /> V. NOTICE <br /> For purposes of delivery of any notices hereunder, the notice shall be effective if <br /> delivered to the County Administrator of Anoka County, 2100 Third Avenue North, <br /> Anoka, Minnesota 55303, on behalf of the County, and the City Administrator of <br /> Centerville, 1880 Main St., Centerville, MN 55038, on behalf of the City. <br /> VI. DISBURSEMENT OF FUNDS <br /> All funds disbursed by the County or City pursuant to this Agreement shall be disbursed <br /> by each entity pursuant to the method provided by law. <br /> VII. INDEMNIFICATION <br /> The City and the County mutually agree to indemnify and hold harmless each other from <br /> any claims, losses, costs, expenses or damages resulting from the acts or omissions of <br /> the respective officers, agents, or employees relating to activities conducted by either <br /> party under his Agreement. <br /> VIII. ENTIRE AGREEMENT REQUIREMENT OF A WRITING <br /> It is understood and agreed that the entire agreement of the parties is contained herein <br /> and that this Agreement supersedes all oral agreements and all negotiations between <br /> the parties relating to the subject matter thereof, as well as any previous agreement <br /> presently in effect between the parties to the subject matter thereof. Any alterations, <br />
