Countv's Responsibilities: <br /> • A. The County shall secure Metropolitan Council approval of the master plan amendment to <br /> include the Leibel property within the boundary of the Rice Creek Chain of Lakes Park <br /> Reserve. <br /> B. The County shall secure an Acquisition Opportunity Grant from the Metropolitan Council <br /> to provide funds for the purchase of the Leibel Property. <br /> C. The County shall purchase the Leibel Property, which will be used by the County as a <br /> park maintenance facility and to interpret a historic Native American burial mound. It is <br /> the goal of the County that construction of the interpretation for the historic site shall <br /> occur as soon as funds are available from the Metropolitan Council for that purpose. The <br /> intent of the parties is that the facilities that would be constructed will interpret the Native <br /> American heritage of the area as well as the burial mound that is on the site. Facilities <br /> may include kiosks with interpretive material as well as a rest area with bike racks and <br /> benches. <br /> D. The County shall grant to the City an easement over the southeast corner of the Leibel <br /> Property, for use by the City to install and maintain a "Welcome to Centerville" <br /> monument sign, as depicted in the attached in Exhibit B. This easement shall run with <br /> the land and shall be reduced to a writing suitable for recording. <br /> E. The County shall sweep the bituminous trail from LaMotte Park to the park entrance on <br /> CSAH 14 as part of the County's regular sweeping program in the Rice Creek Chain of <br /> • Lakes Park Reserve, as depicted in the attached Exhibit C. <br /> F. The County shall perform snow removal on the bituminous trail from LaMotte Park to the <br /> park entrance on CSAH 14 as part of the County's regular snow removal program in the <br /> Rice Creek Chain of Lakes Park Reserve. <br /> G. The County shall rough -cut mow the area between the CSAH 14 trail and Centerville <br /> Lake with a boom -type mower in the late summer, as depicted in Exhibit D. <br /> H. The County shall establish a connection between the Park Maintenance Facility on the <br /> Leibel Property and the City's municipal sewer and water services as soon as funds are <br /> available from the Metropolitan Council for that purpose, but not later than December 31, <br /> 2016. <br /> I. The County shall grant to the City a license agreement over the access road and parking <br /> lot of the Leibel Property allowing its police department non - exclusive use of these areas <br /> for traffic monitoring and enforcement purposes. <br /> J. The County hereby grants to the City the right of first refusal to purchase the Leibel <br /> Property at the County's approved appraised market value in the event the County <br /> decides to sell the property. <br /> K. The County shall comply with Minnesota Statutes, Section 473.341 and make the <br /> appropriate tax equivalency payment to the City according to the terms of said statute as <br /> a result of the County's purchase of the Leibel Property. <br /> 25 <br />
