Admini" Jtl!~ <br />oore- yes, Ity strator ,.. <br /> <br />FROM: <br /> <br />RE: <br /> <br />6939 - 20th Avenue South; Rezoning Request. <br /> <br />......................................................................... <br /> <br />Mr. Lloyd Drilling is requesting that his property at 6939 - 20th Avenue South be rezoned <br />from B-1 Commercial to R-2 SF Residential for the purpose of constructing 15 plus <br />townhomes, which is allowed under this zoning designation. Mr. Drilling has submitted <br />the appropriate application and paid the required fee for rezoning~ The City Clerk <br />published a notice to rezone and sent letters to those property owners affected by this <br />proposed rezoning request as req~ired by the Minnesota statutes. <br /> <br />Just prior to the Planning and Zoning meeting, Staff learned that before this rezoning <br />public hearing can happen at the Council, a public hearing needs to be held to approve <br />the expansion of the City's MUSA, as per Minnesota Statute. Planning and Zoning did <br />open the scheduled rezoning public hearing and took comments from staff and the <br />property owners. There were no residents there but comments received in writing from <br />two residents were read into the minutes. As per the recommendation of the City <br />Attorney, the public hearing was closed and no recommendation to Council was voted on <br />by the Commission. <br /> <br />A similar rezoning request came before you in August, 2002 and Council consensus was <br />to retain the current B-1 zoning status. Staff continues to feel that this rezoning would <br />provide adequate buffering to the industrial area on the east side of 20th Avenue for the <br />residential area to the west of the subject property and would be the best use of this <br />property. Also taken into consideration were the changes to the property tax laws in <br />2001 which compresses tax rates for businesses and apartments and that also expands the <br />tax rates for residential properties. <br /> <br />Also, I have had a call from the Metropolitan Council reminding the City that as part of <br />our agreement to support the state's Livable Community Act, the City has agreed to <br />construct 162 high density, affordable housing. To date, the City has constructed 130 of <br />these units and the Met. Council is interested in the City's future compliance. <br /> <br />Mr. Drilling will be in attendance to discuss the request and'to answer any questions. <br />
