Res. #13 -0 <br /> A RESOLUTION ADOPTING SPECIAL ASSESSMENT ON IMPROVEMENT <br /> WHEREAS, pursuant to proper notice duly given as required by law, the Council has <br /> met, heard and passed upon all objections to the proposed reassessment for improvement <br /> of 21 Avenue from a point approximately 600 feet south of Main Street to a point <br /> approximately 1,400 feet south of Main Street and continuing on a new unnamed street <br /> (now Commerce Drive) parallel to Main Street westerly to 20 Avenue, by installation of <br /> watermain, sanitary sewer, street pavement, curb, storm sewer and related drainage <br /> improvements, <br /> WHEREAS, by Resolution 09 -015, the Council adopted assessments and an Assessment <br /> Roll, related to the aforementioned improvements on June 10, 2009. <br /> WHEREAS, pursuant to Orders from Courts of the State of Minnesota, the Council has <br /> met and heard this matter pursuant to Minnesota Statutes Section 429.017, Subdivision 2 <br /> for the purpose of making a reassessment as to such parcels identified herein. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> CENTERVILLE, MINNESOTA, <br /> 1. Such proposed reassessment, a copy of which is attached hereto and made a part <br /> hereof, is hereby adopted and shall constitute a revision of the previous special <br /> assessment against the lands named therein in keeping with directives of <br /> applicable Order of the District Court and Court of Appeals, and each tract of land <br /> therein included is hereby found to be benefited by the improvement in the <br /> amount of the amended assessment levied against it. <br /> 2. Such proposed reassessment shall follow all of the terms and conditions as <br /> ordered in Resolution 09 -015, adopted June 10, 2009, except as specifically stated <br /> herein. This reassessment shall amend the amount of assessments set forth in the <br /> Assessment Roll attached to Resolution 09 -015 with the amount of assessments <br /> set forth in the amended Assessment Roll attached to this Resolution. The balance <br /> of these amended assessed amounts plus accrued interest shall be payable in <br /> annual installments extending over the remaining period of annual installments. <br /> The first installment of the adjusted balance shall be payable on or before the first <br /> Monday in January, 2014. <br /> 3. The owner of any property so assessed may, at any time prior to certification of <br /> the reassessment to the County Auditor, pay the whole or part of the reassessment <br /> on such property with interest accrued to the date of payment, to the City <br /> Administrator, and he may at any time thereafter, pay to the Administrator the <br /> entire amount of the assessment remaining unpaid, with interest accrued to <br /> December 31 of the year in which such payment is made. Such payment must be <br /> made before November 15 or interest will be charged to December 31 of the next <br /> succeeding year. <br />
