Res. #13 -0 /Z <br /> A RESOLUTION ADOPTING SPECIAL ASSESSMENT ON IMPROVEMENT <br /> WHEREAS, pursuant to proper notice duly given as required by law, the council has met <br /> and heard and passed upon all objections to the proposed assessment for the following <br /> improvements: <br /> Part 1. Center Street from Dupre Road to 20 Avenue, Sumac Court and Ivy Court <br /> by, reconstruction of base and street pavement, curb, storm sewer and related <br /> drainage improvements, and construction of utilities in advance of paving, and <br /> Part 2. Peterson Trail from Main Street to Fox Run, Fox Run from Peterson Trail <br /> westerly to its terminus in the cul -de -sac, Hayfield Road from Peterson Trail to Mill <br /> Road and all of Houle Circle, by removal and replacement of asphalt pavement and <br /> related drainage improvements, and <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> CENTERVILLE, MINNESOTA, <br /> 1. Such proposed assessment, a copy of which is attached hereto and made a part hereof, <br /> is hereby adopted and shall constitute the special assessment against the lands named <br /> therein, and each tract of land therein included is hereby found to be benefited by the <br /> improvement in the amount of the assessment levied against it. <br /> 2. Part 1 Special assessments shall be payable in annual installments extending over a <br /> period of 15 years, Part 2 assessments shall be payable in installments extending over a <br /> period of 10 years. The first installment of such assessments shall be payable on or <br /> before the first Monday in January, 2014 and shall bear interest at the rate of 4.0 percent <br /> per annum from July 1, 2013. Each installment shall include interest to December 31, of <br /> the year of collection. <br /> 3. The owner of any property so assessed may, at any time prior to certification of the <br /> assessment to the county auditor, pay the whole or part of the assessment on such <br /> property with interest accrued to the date of payment, to the City Administrator, except <br /> that no interest shall be charged on any amount paid within 30 days of the adoption of <br /> this resolution and until July 1, 2013; and may at any time thereafter, pay to the <br /> Administrator the entire amount of the assessment remaining unpaid, with interest <br /> accrued from July 1, 2013 to the date of payment. Such payment must be made before <br /> November 15 or interest will be charged to December 31 of the next succeeding year. <br />
