<br />(2) Greater flexibility in zoning regulations often leads to more subjectivity in <br />land use interpretations. In making zoning decisions about land use compatibility and <br />dimensional criteria for uses and structures, the city shall have broad discretion to protect <br />the public health, safety and welfare; and to protect the residential integrity of the Mixed <br />Use District and surrounding residential neighborhoods. <br /> <br />(3) Setbacks and lot coverage for new or expanded structures shall be <br />determined through the site plan review process by the Planning and Zoning . <br />Commission. Factors to be considered in the determination shall include but not be <br />limited to existing setbacks, structural appearance, site drainage, public access, pedestrian <br />safety, automobile safety, intersection visibility, height, parking, landscaping and other <br />site design factors. Residential dwellings shall not be prohibited or discouraged in the M- <br />1 District. <br /> <br />(4) The use or conversion of a residential structure for commercial use, other <br />than a home occupation, shall require site plan approval by the Planning and Zoning <br />Commission. Factors to be considered for such a use conversion include but are not <br />limited to compatibility with adjacent land uses, structural appearance, structural <br />adaptability, investment relationship, term or length of conversion (interim or permanent) <br />and consistency with any land use plans prepared by the city for the Mixed Use District. <br /> <br />(5) The architectural design and exterior building materials used in connection <br />with any new or expanded use or structure shall be consistent with any architectural <br />design or aesthetic control requirements established by the city for the Mixed Use <br />District. <br /> <br />AA 154.091 THROUGH 154.109 RESERVED FOR FUTURE EXPANSION. <br /> <br />Yard-Building and Other Requirements <br /> <br />A 154.110 HEIGHT. <br /> <br />(A) Structures. No structures or building may be erected to a height exceeding 35 <br />feet without the issuance of a conditional use permit. <br /> <br />(B) Excess height on a building. Upon the securing of a conditional use permit any <br />building may be erected to a height exceeding that specified for the respective district, <br />providedthe front, rear and side yards shall be increased one foot for each one foot by <br />which the building exceeds the height limit established for that district. <br />
