<br />(2) Action to approve, modify or deny site plan applications will be <br />based upon consistency of the application with the city's comprehensive plan, zoning <br />chapter, other policies and official controls and the compatibility of the proposed action <br />with existing area land uses, existing area investments and neighborhood character, <br />capacity of public streets and utilities and future planned land uses. <br /> <br />(D) Exceptions. The city may waive certain submittal requirements for <br />residential variance applications, when it is determined that submittal requirements are <br />not applicable or are not necessary to complete a review of the proposed action. The city <br />may also waive certain submittal requirements for other actions, when site plan <br />information for the subject property has previously been submitted to the city and may be <br />more appropriately supplemented with new information. <br /> <br />~~ 154.152 THROUGH 154.159 RESERVED FOR FUTURE EXPANSION. <br /> <br />~ 154.160 WOODLANDS PRESERVATION. <br /> <br />In residential areas, structures shall be located in a manner that the maximum <br />number of woodlands shall be preserved. If large numbers of trees are cut in residential <br />areas, trees shall be replanted in a density and manner satisfactory to the City Council. <br />Clear cutting of woodlands for nonagricultural purposes is prohibited, unless the action <br />involves a utility or roadway, required by the public, and includes a reforestation plan <br />required by the City Council. <br /> <br />~ 154.161 SPECIAL PROVISIONS RELATED TO DEVELOPMENT OR <br />BUILDING ON <br />LANDS WITmN 100 FEET OF CENTERVILLE LAKE, PELTIER LAKE OR <br />CLEARWATER CREEK. <br /> <br />(A) Residential subdivisions with dwelling unit densities exceeding four-unit <br />structures can only be allowed if designed and approved as residential planned unit <br />developments under this chapter. Only land above the ordinary high water level of public <br />waters can be used to meet lot area standards, and lot width standards must be met at both <br />the ordinary high water level and at the building line. <br /> <br />(B) All shoreland development shall meet the following standards: <br /> <br />(1) The minimum lot size shall be 15,000 square feet, not less than 100 feet in <br />width, each building must be set back at least 75 feet from the ordinary high water level <br />for lands adjoining a lake; <br /> <br />(2) Minimum lot size shall be 15,000, 100 feet in width and set back at least 50 <br />feet from the ordinary high water lever for Clearwater Creek; <br />
