RESOLUTION NUMBER 13 -009A A RESOLUTION TO CLARIFY THE SUBSTANCE AND ADOPTION OF RESOLTUION 13 -009 WHEREAS, a public hearing and public meeting were held before the City Council on February 13, 2013, to consider the matter of a special assessment against property owned by the Sheehy Construction Company, and WHEREAS, the Council packet and adopted Agenda for the February 13, 2013, public meeting contained an item of new business entitled, "Resolution 13 -Oxx — Adopting Special Assessment (Backage Road /Commerce Drive)" and a proposed Resolution 13- Oxx. WHEREAS, at that public meeting Councilmember Fehrenbacher moved for the adoption of "Resolution 13 -Oxx" as proposed from the Agenda, and the Council unanimously adopted that Resolution without amendment, and WHEREAS, staff prepared the newly adopted Resolution as a written document for inclusion into the public record by assigning it as Resolution 13 -009, and WHEREAS, during September 2013, staff discovered it had inserted an early draft of Resolution 13 -009 into the public record instead of the version which was adopted by the Council. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF CENTERVILLE, MINNESOTA: 1) On February 13, 2013, the Council adopted the version of Resolution 13 -009 attached as an Exhibit hereto. 2) The Council directs that all previous version(s) of Resolution 13 -009 now in the City's public record shall be replaced with the version of Resolution 13 -009 attached as an Exhibit hereto.
