RESOLUTION 13 -029 <br /> A RESOLUTION AUTHORIZING THE CITY OF CENTERVILLE TO ENTER <br /> INTO AN ENCROACHMENT AGREEMENT WITH PROPERTY OWNER OF <br /> 7355 OLD MILL ROAD (PIN #R14- 31 -22 -31 -0058) (LOT 6, BLOCK 1 <br /> CLEARWATER CREEK ESTATES) ALLOWING CONSTRUCTION OF A <br /> FENCE IN THE CITY'S RIGHT -OF- WAY/DRAINAGE UTILITY EASEMENTS <br /> WHEREAS, on August 28, 2013 Mr. Larry E Olson Trustee & Mrs. Michelle Ann Olson <br /> Trustee submitted application to the City to construct a fence on their property within the <br /> City's right -of -way /Drainage Utility Easements (side and rear yard); and <br /> WHEREAS, the Building Official reviewed the application and found it to be complete, <br /> appropriate fees were paid and that the encroachment would not cause undue harm to if <br /> placed in the easement, and <br /> WHEREAS, the encroachment agreement was submitted to the City Council for <br /> consideration, and <br /> WHEREAS, the subject property is torrens property which requires additional action by <br /> Council approving said the agreement attached as Exhibit A. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br /> CENTERVILLE, MINNESOTA, <br /> 1. The Mayor and City Clerk are herby authorized to execute the encroachment <br /> agreement on behalf of the City. <br /> 2. The Clerk shall provide to the Anoka County Recorder a certified copy of this <br /> resolution together with the Encroachment agreement and a certified copy of the <br /> minutes approving this action. <br /> Adopted by the Council this 13 day of November, 2013. <br /> Tom Wilharber, Mayor <br /> CAttest: -- <br /> Teresa Bender, City Clerk <br />
