City of Centerville <br />Planning and Zoning Commission <br /> <br />September 10, 2013 <br /> <br />None <br /> <br />V. NEW BUSINESS. <br /> <br /> <br />1. Proposal by Rehbein Properties to continue black dirt processing on their industrial <br />property. Matt Rehbein was present to speak on behalf of the owner. <br /> <br />Administrator Larson reviewed the proposal, noting that the existing operation is not in <br />conformance with the current Zoning Code and the City has not issued any permits for the <br />property. The City reached an unwritten agreement with the owner to not bring in any new dirt in <br />order that the non-conforming operation be phased out. The dirt, at one point, may have been up to <br />300,000 cubic yards. Matt Rehbein reports that there is less than 50,000 cubic yards remaining on <br />the property. <br /> <br />A preliminary application was reviewed. The application was not complete and no fees or deposits <br />have been paid. The proposal requests that up to 300,000 cubic yards of black dirt be allowed and <br />up to 500,000 cubic yards of compactable fill be allowed on the site. Mr. Rehbein indicated that <br />most of the compactable material would be used on the property to prepare it for development. <br /> <br />The Commission discussed the potential impact on the access streets and the fact that this is a very <br />intensive use on a property that does not contribute much in the way of taxes. It was suggested that <br />a per yard fee could off-set that concern, possibly ten cents per yard for material brought in and 25 <br />cents per yard for material leaving the site. If a permit were issued, limitations placed on the <br />operation could include hours of operation, speed of trucks, sweeping of streets, erosion and <br />sediment control, maximum height of piles, etc. The Commission suggested that a cross-section <br />survey be completed to determine what amount of material is still remaining on the site and to <br />determine what heights could be expected on piles if the permit allowed the requested volumes. <br />Also, information should be provided to show how much compactable material is needed to <br />balance the sites for development. <br /> <br />When additional information is provided, and application fees and deposits paid, it may be <br />possible to get a determination in October that the application is complete and then to schedule a <br />public hearing in November. <br /> <br />VI.
