ANOKA COUNTY <br /> FIRE PROTECTION COUNCIL <br /> JOINT POWERS AGREEMENT <br /> THIS AGREEMENT is made and entered into this_ day of , 2014, by and <br /> between the following governmental units: the cities of Anoka, Champlin, Andover, Bethel, <br /> Centerville, Lino Lakes, Circle Pines, Coon Rapids, Columbia Heights, East Bethel, Fridley, <br /> Ham Lake, Hilltop, Lexington, Nowthen, Oak Grove, Ramsey, St. Francis, Spring Lake Park, <br /> Blaine, Mounds View and the Township of Linwood (collectively "Governmental Units "). <br /> WHEREAS, the above named governmental units have determined that it is mutually <br /> beneficial for the governmental units to cooperatively address their long term needs for fire- <br /> fighting equipment, fire records data systems, fire - fighter training, fire prevention, inspection <br /> and public education; and <br /> WHEREAS, the above named governmental units may enter into this joint powers <br /> agreement pursuant to the authority set forth in Minn. Stat. § 471.59; and <br /> WHEREAS, the above named governmental units have previously participated in <br /> mutual aid agreements which have been successful in light of encouraging cooperation among <br /> the group but do not provide sufficient legal authority for the group to meet upcoming needs <br /> and desires; and <br /> WHEREAS, the creation of a joint powers agreement will meet the legal needs for the <br /> group to accomplish the goals as set forth herein, including interaction with the Anoka County <br /> Joint Law Enforcement Council on the public safety data system; and <br /> WHEREAS each of the governmental units have considered the alternatives and <br /> agreed that creation of this joint powers agreement is in the governmental unit's best interest, <br /> THEREFORE, in consideration of the mutual promises and benefits that each party <br /> shall derive herefrom, and other good and valuable consideration, the parties agree as follows: <br /> ARTICLE I <br /> Definitions <br /> In the interpretation of this Agreement, the following definitions shall have the meanings given <br /> to them. <br /> (1) "Governmental unit" shall have the meaning ascribed in Minn. Stat. § 471.59. <br /> (2) "Anoka County Fire Protection Council" or "FPC" is the name of the cooperative body <br /> created by this Joint Powers Agreement. <br /> D -1 <br /> 19 <br />
